10/21/2010 Regular Meeting KODIAK ISLAND BOROUGH Assembly Regular Meeting October 21, 2010 A regular meeting of the Kodiak Island Borough Assembly was held on Thursday, October 21, 2010, in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 7:30 p.m. The invocation was given by Captain John Quinn of the Salvation Army. Mayor Selby led the Pledge of Allegiance. Present were Mayor Jerome Selby, Assembly members Pat Branson, Judy Fulp, Sue Jeffrey, Dave Kaplan, Chris Lynch, and Louise Stutes. Staff members present were Administrative Official Bud Cassidy, Clerk Nova Javier, and Assistant Clerk Jessica Kilborn. BRANSON moved to excuse Assembly member Friend who was absent due to personal leave. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF AGENDA AND CONSENT AGENDA JEFFREY moved to approve the agenda and consent agenda. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF MINUTES A. Regular Meeting Minutes of September 16, 2010, were approved under the consent agenda. AWARDS AND PRESENTATIONS Mayor Selby proclaimed October 23, 2010, as Coast Guard Appreciation Day in Kodiak, urging citizens to recognize our coast guard community for its individual and collective efforts in making Kodiak and all the navigable waters of Alaska a safer and better place to live, work, and play. Administrative Official Cassidy presented five -year longevity awards to Jessica Basuel, Interpretive Specialist/Receptionist in the Engineering and Facilities Department; Dria Bray - Holloway, General Accountant in the Finance Department; Andrew Carmichael, PC Technician 1 in the Information Technology Department; a ten -year longevity award to Brian Smith, Baler Operator 1 in the Engineering and Facilities Department; and a twenty -year longevity award to Sharon Blakeslee, Programmer /Analyst in the Information Technology Department. Administrative Official Cassidy presented the Employee of the Quarter Award to Marilyn Ordal, Accounting Technician /Accounts Payable in the Finance Department. Mayor Selby presented the Certified Municipal Clerk Designation to Jessica Kilborn, CMC, Assistant Clerk in the Borough Clerk's Office. Kodiak Island Borough Assembly Minutes October 21, 2010 Page 846 CITIZENS' COMMENTS Rhonda Maker spoke on the letter that was sent to the North Pacific Fishery Management Council (NPFMC) regarding the tanner crab by- catch. COMMITTEE REPORTS Assembly member Stutes reported that the Southwest Alaska Municipal Conference (SWAMC) annual conference would be held February 10 -11, 2011, in Anchorage. PUBLIC HEARING None. BOROUGH MANAGER'S REPORT Administrative Official Cassidy reported on the following: • Manager Gifford would be out of the office until November 2, 2010. • Assembly participation was needed during a meeting with the Code Revision Consultants, along with the Planning and Zoning Commission, Project Advisory Committee, and the public. The meeting was scheduled on Wednesday, December 8, 2010, at 6:30 p.m. MESSAGES FROM THE BOROUGH MAYOR Mayor Selby commended Duncan Fields for the great job he did at the NPFMC meeting regarding the tanner crab by -catch issue which included consideration of the economic impact it would have on the Kodiak community. UNFINISHED BUSINESS None. NEW BUSINESS Contracts None. Resolutions 1. Resolution No. FY2011 -07 Appointing a Member to the Kodiak Fisheries Development Association. This item was approved under the consent agenda. The Kodiak Island Borough and City of Kodiak jointly designated the Kodiak Fisheries Development Association (KFDA) as the eligible crab community entity (ECCE). The by -laws of the KFDA provided for appointments of Directors to the Board by the Kodiak Island Borough Assembly and the Kodiak City Council. One of the three joint KFDA Director's seats term expired in July 2010. Mr. Stosh Anderson indicated his desire to be reappointed to the expired joint seat for a term to expire July 2013. Since there was no Borough /City Joint Work Session scheduled, both the Borough and City Managers proposed to present the reappointment of Mr. Anderson to the respective bodies. Resolution No. FY2011 -08 Approving the Formation of a Project Advisory Committee (PAC) to the Planning and Zoning Commission and Confirming the Mayoral Appointees to this Committee. BRANSON moved to adopt Resolution No. FY2011 -08. The Borough hired a consultant to work with the community and the Planning and Zoning Commission to update the portions of the Borough Code that regulated land division (Subdivision), and regulation (Zoning), and Borough owned property (Borough Real Property). As part of this review it was recommended that the creation of a committee made up of Kodiak residents who represented a broad segment of the community and who regulated and /or created regulations affecting private land. This committee would be known as the Project Advisory Committee (PAC) under the Planning and Zoning Commission and would work with the consultant and the community to make recommendations to the Commission on changes to these code sections. The names of the appointees were suggested after interviewing over 50 Kodiak residents regarding Borough zoning, subdivision, and public land regulations. Those appointed to the committee were: Mark Anderson, Janet Buckingham, Beth Davis, Oliver Holm, Ted Panamarioff, Dan Rohrer, Andy Schroeder, Marty Shuravloff, Lucas Smith, Sonny Vinberg, and John Whiddon. Mayor Selby noted that the resolution needed to be amended to reflect the Mayoral appointments of Planning and Zoning Commissioners Casey Janz and Alan Torres to the committee. The Assembly appointment to the committee would be determined at a later date. BRANSON moved to amend Resolution No. FY2011 -09 to include Planning and Zoning Commissioners Casey Janz and Alan Torres to the Project Advisory Committee. Resolution No. FY2011 -09 Ratifying and Certifying the Results of the Municipal Election Held October 5, 2010. JEFFREY moved to adopt Resolution No. FY2011 -09. The Kodiak Island Borough election was held on October 5, 2010. The Canvass Board met October 12 and 13, 2010, and examined in detail the results from the different precincts including write -ins, absentee and questioned ballots, by -mail, and personal representative ballots. Provided to the Assembly and public was a report of the canvass board which included the resolution ratifying and certifying the results of the municipal election. Resolution No. FY2011 -10 Declaring the Intent of the Kodiak Island Borough to Reimburse Original Expenditures for Costs of School Capital Improvements With Proceeds of Tax Exempt Bonds. KAPLAN moved to adopt Resolution No. FY2011 -10. The Borough anticipated awarding a contract to an architectural firm to design the Kodiak High School Renovation and Renewal project in Fall 2010, with work to begin before the end of the year. The first bond issued to pay for the work was anticipated to be made in Spring 2011. Approval of this resolution reflected the Borough's intent to pay for the work with the proceeds of the Kodiak High School Renovation and Renewal bonds. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Kaplan, Lynch, Stutes, Branson, Fulp, and Jeffrey. Ordinances for Introduction None. Other Items 1. Donation of Artifacts to the Alutiiq Museum. BRANSON moved to authorize the Manager to donate the collection of artifacts discovered on Borough property on Woody Island to the Alutiiq Museum to oversee its care in perpetuity. This was to acknowledge donation by the Kodiak Island Borough to the Alutiiq Museum of a collection of artifacts excavated in 2009 at a prehistoric archaeological site located on Borough property on Woody Island. The collection, known as KOD -953, included 526 stone artifacts and samples (soil, wood charcoal, and burned bone fragments), project field notes, and photographs. An inventory of materials was provided. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Lynch, Stutes, Branson, Fulp, Jeffrey, and Kaplan. 2. Administer Oath of Office to Newly Elected Officials. The Borough Clerk administered the Oath of Office to Newly- Elected Mayor Jerome Selby and Assembly member Louise Stutes. Newly- Elected Assembly member Carol Austerman was not available to be sworn into office at the time of the meeting. Arrangements had been made to administer the Oath of Office to Assembly member Austerman in the Clerk's Office at a later date. 3. Presentation to Outgoing Assembly Member. Mayor Selby presented a plaque of appreciation to outgoing Assembly member Pat Branson. CITIZENS' COMMENTS None. Kodiak Island Borough Assembly Minutes October 21, 2010 Page 849 ASSEMBLY MEMBER COMMENTS Assembly members congratulated recipients of the longevity awards, employee of the quarter award, and the CMC designation. Assembly members also thanked Assembly member Branson for her years of public service and wished her well on future endeavors. Assembly member Lynch inquired about the status of the issue of citizens shooting road signs that the Parks and Recreation Committee wished to bring before the Assembly. Administrative Official Cassidy responded that the Enforcement Officer was working toward identifying responsible parties. Citizens were encouraged to make any reports to the State Troopers regarding individuals who were suspected to be involved; other preventive measures were being taken. Assembly member Stutes commended the Enforcement Officer for his presence throughout the community and commented on the lack of garbage service on Sundays. Assembly member Kaplan congratulated Mayor Selby and Assembly member Stutes for being reelected. Assembly member Fulp congratulated the Borough for its efforts with the new Woody Way recreation field project and commented on the existence of the logging trucks within the Womens Bay area. Assembly member Jeffrey acknowledged Coast Guard Appreciation Day held on October 23, 2010. She also spoke on the issues of overflowing dumpsters and the log storage facility. Administrative Official Cassidy noted that the responsibility of traffic management and storage issues regarding the logging project fell under the authority of various entities. Concerns of the Womens Bay Service Area involving possible fire issues near the logging storage area were being discussed. Assembly member Branson congratulated the Coast Guard for its involvement with the community. She thanked her colleagues and stated it was a pleasure working with the Assembly and the Borough staff. Announcements Mayor Selby announced that absentee in person voting was available October 18, 2010, through November 1, 2010, in the Borough Clerk's Office, Room 101 from 8 a.m. to 5 p.m., Monday through Friday. The next Assembly work session would be held on Thursday, October 28, 2010, at 7:30 p.m. in the Borough Conference Room. The next regular meeting was scheduled on Thursday, November 4, 2010, at 7:30 p.m. in the Borough Assembly Chambers.
