The Kodiak Island Borough School District has a compelling

To whom it may concern:
Please accept this letter as a supplement to my application for a seat on
the Solid Waste Advisory Board (SWAB). I wanted to clarify that,
although, I am an employee of Senior Citizens of Kodiak, Inc., I am first
and foremost a small business owner. My husband Rod and I have run
our business, Alpha Appliance Repair on Kodiak Island since 1993. We
have always been committed to providing the residents of Kodiak with
service and products that they can trust and rely on. We take pride in
being responsible retailers and have always been conscientious regarding
the disposal of junk appliances. We have always been committed to
diminishing the amount of solid waste that we generate which ultimately
ends up in the landfill. We have successfully diminished our impact on the
landfill by offering to the public quality pre -owned appliances at
reasonable rates. We have always felt that by selling used appliances
that accumulate on the island we were helping to keep them out of the
landfill and also providing the residents of Kodiak an alternative to
purchasing new appliances, therefore utilizing the resources already
available here.
I realize that it is the goal of SWAB to staff itself with a broad range of
individuals, I believe I am the right candidate for this position. I feel that
my knowledge of the retail sector in this community both through my
experience as a small business owner and a former employee of the
Chamber of Commerce, I have gained very good insight into the solid
waste dilemma that businesses and individuals face in our community. As
a retailer and servicing company I have dealt with wide range of issues
and situations, I have always prided myself on my ability to recognize a
problem and work towards a solution.
Our appliance business is ever - expanding, we have recognized the need
for energy efficient appliances and water heating systems and are now
moving toward expanding our business into these areas. We are
constantly updating and analyzing how we do business and what steps we
can take to diminish our impact on our community. Our business
generates a large amount of metal and plastic trash and until recently, we
were forced to dispose of junked appliances into the landfill. Now with the
availability of a full - service recycling center we have been able to recycle
many of these things and keep them out of the landfill. As a business
owners, we take pride in our efforts and hope to continue our recycling
efforts into the future.
I believe I have a great deal of knowledge about how to operate a
successful business. I am willing to use my experience, my passion for
taking care of our island and my belief that Kodiak's solid waste issues can
be solved in a rational, ecolomical fashion.

Per the Assembly's request at its work session on May 8, 2008, the following addresses
the process for searching for legal services for the Borough.
Borough code Chapter 2.24 authorizes the Assembly to hire an attorney to act on behalf
of the borough as legal counsel and provides that "the assembly shall appoint the
attorney by resolution ". KIBC 2.24.030 states that "the attorney shall serve at the
pleasure of the assembly and may be removed by order of the assembly." The
Assembly may wish to meet with the Borough Attorney, in executive session, to discuss
services and performance.
The Honorable Mayor and Assembly of the Kodiak Island Borough
If the Assembly decided to do a search for an attorney to provide legal services,
Borough code Chapter 3.16 establishes the procedures for contracting for services.
KIBC 3.16.070 (A) provides for exceptions to the bidding requirements which includes
"contracts for professional or unique services ".
Therefore, based on the two code chapters above, the Assembly appoints the Borough
attorney and can bypass the normal bidding requirements for selection of an attorney.
The most common procedure for searching for attorney services would be for the
Borough to issue a Request for Proposals (RFP) and advertise for legal services. Upon
receipt of the proposals, the Assembly, through a selection process, can select the law
firm /attorney that they feel would best represent the Borough as legal counsel. The
Assembly would then negotiate a contract for legal services.

AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY ESTABLISHING
A PROCEDURE FOR OBTAINING LEGAL COUNSEL FOR THE BOROUGH
WHEREAS, Alaska Statutes allows the assembly to provide the
manner of appointing legal counsels and
WHEREAS, the Kodiak Island Borough has need of legal counsel
to represent the borough and be recognized as the borough attorney:
NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island Borough
Assembly that:
Section 1. This ordinance is of a permanent and general
nature and shall become a part of the Code.
Section 2. A new chapter, 2.24, is hereby enacted as follows:
Chapter 2.24
BOROUGH ATTORNEY
2.24.010 Borough Attorney. Because the borough may sue and be
sued and may enter into legal agreements, the borough assembly may
retain legal counsel to act on the borough's behalf and to be recognized
as the borough attorney.
2.24.020 Procedure for Appointment. The assembly shall appoint
the borough attorney by resolution.
2.24.030 Service and Removal. The borough attorney shall serve at
the pleasure of the assembly and may be removed by order of the
assembly.

WHEREAS, the Kodiak Island Borough Assembly has need of legal

WHEREAS, the Assembly desires to retain legal counsel to act

15125.00 per hour for such representation.

alternative counsel to represent the borough when conflicts of interest
arise.

A RESOLUTION RETAINING LEGAL COUNSEL
FOR THE KODIAK ISLAND BOROUGH
WHEREAS, the Kodiak Island Borough assembly has need of legal counsel since the
Borough, from time to time, may sue and be sued; and
WHEREAS, the assembly desires to retain legal counsel to act on the Borough's

WHEREAS, a regular review and reauthorization of legal counsel by the assembly is
a good way of doing business;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that this resolution replaces Resolution No. 87 -38 -R that retains legal
counsel for the Kodiak Island Borough.
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE ASSEMBLY OF THE KODIAK
ISLAND BOROUGH that the law firm of Jamin, Ebell, Schmitt and Mason is hereby
retained as the Kodiak Island Borough attorney to represent the Kodiak Island Borough
in matters of law and that said law firm will be reimbursed at the rate of $150.00 per
hour for such representation, unless otherwise specified at the onset of a particular
litigation.
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE ASSEMBLY OF THE KODIAK
ISLAND BOROUGH that the assembly shall seek alternative counsel to represent the
Borough when conflicts of interest arise.
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE ASSEMBLY OF THE KODIAK
ISLAND BOROUGH that this agreement is valid for three years, ending September 30,
2000, at which time this agreement must be reauthorized or new legal counsel
