Assembly Special Meeting
May 14, 2009
A special meeting of the Kodiak Island Borough Assembly was held Thursday, May 14, 2009 in
the Borough Conference Room of the Kodiak Island Borough Building, 710 Mill Bay Road. The
meeting was called to order at 7:30 p.m.
Present were Mayor Jerome Selby, Assembly members Pat Branson, Jerrol Friend, Judy Fulp,
Dave Kaplan, Chris Lynch, and Louise Stutes. Staff members present were Manager Rick
Gifford, Finance Director Karl Short, Borough Clerk Nova Javier, and Deputy Clerk Marylynn
McFarland.
BRANSON moved to excuse Assembly member Jeffrey who is out on personal leave.
VOICE VOTE ON MOTION CARRIED UNANIMOUSLY.
CITIZENS' COMMENTS
Theresa Peterson spoke about the rock fish pilot program and it being the first limited access
fish program to go through the NPFMCI process under the reauthorized Magnuson Stevens Act.
Brian Young, Dennis Hilsinger, Glenn Mathes, Kelly Young, Sarah Reed, Gary Carver, Janet
Wente, Nichole Whittle, Mary Mathes, Tom Schwantes, and Dale Rice spoke regarding the "B"
tracts located in Women's Bay, the maintenance of the haul roads, the issue of putting the lease
out for bid, and the conditions of the existing and future leases.
Shawn Dochtermann and Stephen Taufen spoke to the issue of the North Pacific Fishery
Management Council taking action that reduced the total number of longline and pot cod Limited
License Permit (LLP) holders in the Gulf of Alaska.
Mike Anderson spoke in support of Brechan Enterprises, Inc. leasing the "B" tracts located in
Women's Bay.
Jascha Zbitnoff, representative from Brechan Enterprises, explained the road maintenance
procedure for the haul roads and the role the service area board plays in the process.
CONSIDERATION OF MATTERS IN THE CALL FOR THE SPECIAL MEETING.
A. Resolution No. FY2009 -33 Authorizing the Approval of a Renewed Short -Term Lease and
Material Sales Agreement with Brechan Enterprises, Inc. For Tracts B1, B2, B3 AND B4 -A,
Bells Flats Alaska Subdivision.
FRIEND moved to adopt Resolution No. FY2009 -33.
The Kodiak Island Borough and Brechan Enterprises, Inc. entered into a material site
agreement for gravel extraction on the `B' tracts located in Womens Bay. The material found at
this site was a valuable source of aggregate for the concrete and asphalt produced on the
island. The value of this material and its limited supply had been identified by the Kodiak Island
Gravel Taskforce as the best quality material that was readily available. Staff recommended
granting Brechan Enterprises, Inc. a one year extension to the existing lease to expire on June
30, 2010. During this time period, staff and Brechan Enterprises, Inc. would finalize a long term
lease and material sales agreement.

State of Alaska Alcoholic Beverage Control Board Kodiak Inn, Inc. Request for Transfer
of Controlling Interest. Applicants: Judith E. Johnson, John R. Johnson, and Douglas L.
Johnson.
SUMMARY:
5.01.030 New license and transfer procedure.
A. Upon receipt of notice from the Alcoholic Beverage Control Board of the board's receipt of
an application or intent to approve the transfer or issuance of a new liquor license:
1. The clerk shall investigate to determine if the borough has an interest which can be
protected by protesting the approval of the application for transfer or issuance of a new
liquor license;
2. The clerk shall check with the state troopers on the number of trouble reports at the
place of business;
3. The clerk shall duly advertise and place the matter of the application upon the agenda
for the next meeting of the assembly in order that citizens may express their desires as
to whether or not the assembly should approve or protest the transfer or issuance of the
liquor license; and
4. The notice of intent to establish a new liquor license or transfer of location of an existing
license shall be mailed to each landowner within 1,500 feet of the proposed location by
the clerk. A transfer from one person to another of a liquor license, even if the location
stays the same, shall be considered a request for a new liquor license by the Kodiak
Island Borough. The applicant shall pay a fee based upon the cost of the notice and
application processing costs to the borough.
B. The assembly, after public hearing, shall determine by motion if a protest to the application
is to be lodged with the Alcoholic Beverage Control Board. If a protest is lodged, the
manager and attorney are authorized to use any document or evidence necessary to
effectively advance the position of the borough at any hearing before the Alcoholic Beverage
Control Board.

18 Section 1: This ordinance is not of general application and shall not be codified;

20 Section 2: The following sums of money, or as much thereof as may be authorized by law,
21 as may be needed or deemed necessary to defray all expenses and liabilities of
22 the Kodiak Island Borough, be and the same, is hereby appropriated for municipal
23 purposes and objects of the Kodiak Island Borough and other taxing entities
24 hereinafter specified for the fiscal year commencing on the first day of July 2009
25 and ending on the thirtieth day of June 2010;

27 Section 3: Adoption of this ordinance recognizes that funds are appropriated at department
28 and /or project level. Compositions of these figures are as delineated in the full
29 detail budget document. The full document is available to all elected and
30 appointed officials for their use. Copies may be reviewed by interested citizens at
31 the Borough Building during normal working hours and also at the A. Holmes
32 Johnson, Chiniak, and village public libraries during their normal operating hours
33
34 Section 4: Tax Levy. A tax for the amount specified in the form of a mill levy is hereby levied
35 for the value as of January 1, 2009, to be used for the purposes as specified in
36 the Budget for the Fiscal Year 2010 of the Kodiak Island Borough commencing on
37 the first day of July 2009 and ending on the thirtieth day of June 2010 to defray
38 expenses and liabilities of said entity as enumerated in the applicable budgets.

Contract No. FY2009 -19 Between the Kodiak Island Borough and the Kodiak Chamber of
Commerce for Economic Planning and Project Development within the Kodiak Island
Borough for FY2010.
The Kodiak Island Borough has participated in a community -based economic development
program operated by the Kodiak Chamber of Commerce for many years. Funding support from
the Borough and the City of Kodiak has been used to establish an Economic Development
Specialist Position at the Chamber. This position ensures that the Kodiak Island Borough is
provided with economic development expertise and support. The position is responsible for
meeting planning and reporting requirements established by the Federal Economic
Development Administration and for supporting the Kodiak Comprehensive Economic
Development Strategy (CEDS) Committee. This contract would renew this relationship for the
2010 fiscal year. The duties to be accomplished for this period are outlined in the attached
agreement document.

to exceed $43,000.
ECONOMIC DEVELOPMENT PROGRAM AGREEMENT
THIS AGREEMENT is entered into by and between the Kodiak Island Borough,
Alaska (Borough) and the Kodiak Chamber of Commerce (contractor) for the purpose of
setting forth the terms and conditions pursuant to which the contractor shall be contracted
to provide economic development activities.
Section 1. INTENT OF AGREEMENT. The contractor is hereby contracted
to provide an economic development committee and staff to focus on economic
development planning and project development in the Kodiak Island Borough.
Section 2. SCOPE OF WORK. The contractor will provide staff who will serve
on the economic development committee drawn from the Kodiak Island community with
representatives from the City of Kodiak, Kodiak Island Borough, Kodiak Island outlying
communities, and with the Kodiak Chamber of Commerce. Staff will work with the
Committee to accomplish the following tasks identified in the document, such as:
a. Continue to facilitate the Kodiak Fisheries Advisory Council and forward
recommendations on to the Borough Assembly.
b. Work with the National Marine Fisheries Service, University of Alaska
Fishery Industrial Technology Center, and local processors to achieve stability
and diversification in the fish processing industry by encouraging secondary
and value -added processing, harvesting of under- utilized species, and by
maximizing by- product utilization.
c. Actively pursue business opportunities created by the completion of the
Kodiak -Kenai Cable Company, LLC fiber optics project.
d. Work with the Kodiak Branding and Marketing Committee in their efforts to
develop and implement a marketing plan and quality assurance program for
Kodiak seafood.
e. Work with the Kodiak Island Convention and Visitors Bureau to transform the
visitor industry into a significant component of the Kodiak Region's
economy.
f. Work with local retailers to promote a Shop Local Campaign. Continue to
build on the success of the past years Sales Tax Free Day.
g. Participate on the Kodiak College Advisory Council fostering their goals to
provide higher education options and opportunities for Alaskans.
h. Work with Kodiak College, the Kodiak Island Borough School District,
Kodiak Area Native Association, and other organizations to encourage
entrepreneurship and assist small business development
i. Continued participation and involvement with Southwest Alaska Municipal
Conference in their efforts to bring economic stability to the region.
j. Work with educational institutions, public funding entities and industry to
develop a comprehensive economically sustainable fisheries research facility
in Kodiak;
k. Explore new employment and business opportunities related to the Kodiak
Launch Complex;
1. Explore ways of enhancing Kodiak's position as a regional transportation hub.
m. Assist in the economic development of Kodiak Region outlying communities.
A minimum of four Comprehensive Economic Development Strategy committee
meetings will be scheduled during the term of this Agreement for the purpose of
maintaining committee input and guiding the efforts of the contractor. A report of
all activities of the contractor will be submitted to the Borough Manager
following each meeting.
Section 3. TERM. This agreement will remain in effect July 1, 2009 through
June 30, 2010, unless earlier terminated. Either party shall have the right to terminate the
agreement without penalty upon one month's written notice to the other.
Section 4. COMPENSATION. As compensation for all services rendered under
this agreement, contractor shall be paid $43,000.00 by the Kodiak Island Borough. Said
compensation shall be paid in equal installments of $10,750.00 on the second Friday of
July and October 2009, and January and April 2010.
IN WITNESS WHEREOF the parties have executed this Agreement on this day
of May 2009.

Alaska, (Borough) and the Kodiak Island Convention and Visitors Bureau (contractor)
for the purpose of setting forth the terms and conditions pursuant to which the contractor
shall be contracted to provide destination marketing and tourism development activities
for the Kodiak Island Borough.
Section 1. INTENT OF AGREEMENT. The contractor is hereby contracted to
provide a Marketing Committee (KICVB Board of Directors) and one full time
equivalent to focus on destination marketing and tourism development in the Kodiak
Island Borough.
Section 2. SCOPE OF WORK. The contractor will work with the Marketing
Committee to accomplish the following tasks identified in the document, such as:
a. Produce collateral marketing materials, including the Explore Kodiak Visitor
Guide
b. Continue to provide information about Kodiak region to the traveling public
c. Maintain and staff the Kodiak Visitor Center
d. Keep the Borough Assembly and community at large informed as to the
results of marketing efforts and the state of the local tourism industry
e. Work with the Alaska Travel Industry Association and other statewide
marketing organizations to ensure Kodiak is represented in their ongoing
national and international marketing programs
f. Continue work with the communities in the Kodiak Island Borough to
determine the role tourism does and can play in the community economies
g. Work with the Kodiak Chamber of Commerce to transform the visitor
industry into a significant component of the Kodiak region's economy
h. Continue development of the kodiak.org website to improve its usability and
visibility to visitors, potential businesses and residents
i. Work with Kodiak College, the Kodiak Island Borough School District,
Kodiak Area Native organizations, and other organizations to encourage
entrepreneurship and assist small business development in the visitor industry
j. Develop a travel press kit to be available on the kodiak.org website, develop a
distribution plan for the kit to various travel media
k. Explore new employment and business opportunities related to the Kodiak
visitor industry

A minimum of four Marketing Committee meetings will be scheduled during the
term of this Agreement for the purpose of maintaining committee input and
guiding the efforts of the contractor. A report of all marketing activities of the
contractor will be submitted to the Borough Manager on a quarterly basis. An
annual report to the Kodiak Island Borough Assembly shall be presented each
spring.
Section 3. TERM. This agreement will remain in effect July 1, 2009 through
June 30, 2010, unless earlier terminated. Either party shall have the right to terminate the
agreement without penalty upon one month's written notice to the other.
Section 4. COMPENSATION. As compensation for all services rendered under
this agreement, contractor shall be paid $55,000.00 by the Kodiak Island Borough. Said
compensation shall be paid in equal installments of $13,750.00 on the second Friday of
July and October 2009, and January and April 2010.
IN WITNESS WHREROF the parties have executed this Agreement on this day of
May 2009.

14 WHEREAS, the American Recovery and Reinvestment Act of 2009, Public Law 111 -5,
15 appropriates funding for the Department of Energy (DOE) to issue /award formula -based grants
16 to states, U.S. territories, units of local government, and Indian tribes under the Energy Efficiency
17 and Conservation Block Grant (EECBG) Program; and
18
19 WHEREAS, the Kodiak Island Borough is eligible to receive a direct formula grant in the amount
20 of $50,000 under the Energy Efficiency and Conservation Block Grant Program; and
21
22 WHEREAS, the City of Kodiak is also eligible to receive a direct formula grant in the amount of
23 $50,000 under the Energy Efficiency and Conservation Block Grant Program and will pool grant
24 funds with the Kodiak Island Borough; and
25
26 WHEREAS, Borough staff have identified projects to be performed with the use of the Energy
27 Efficiency and Conservation Block Grant funds. These projects include development of a Climate
28 Action Plan in conjunction with the City of Kodiak which will build upon the Baseline Green
29 House Gas Emission Inventory for Municipal Operations in Urban Kodiak performed in fiscal year
30 2007; and energy retro fits to equipment and fixtures in the Borough Building, also in conjunction
31 with the City of Kodiak, that will reduce energy use and /or greenhouse gas emissions and
32 operation costs for both municipal entities; and
33
34 WHEREAS, the grant application requires an assurance designating the proper authority to
35 apply for and receive the funding;

37 NOW, THEREFORE BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
38 BOROUGH that the Borough Manager is authorized to apply for and receive funds from the U.S.
39 Department of Energy, Energy Efficiency and Conservation Block Grant Program.

2009 BUDGET BY AMENDING BUDGETS TO ACCOUNT FOR VARIOUS REVENUES THAT
ARE OVER BUDGET, PROVIDE FOR ADDITIONAL EXPENDITURES, BUDGET NEW
PROJECTS, AND MOVE FUNDS BETWEEN PROJECTS.
SUMMARY:
• In the General Fund, the miscellaneous line item in the revenue section of the General Fund
is increased by $67,000.
• The "use of fund balance" in the General Fund is increased by $121,000.
• The School District Support Department is decreased by $84,000.
• Transfers out is increased by $272,000; $62,000 is for increased costs in the School
Buildings Department in the Building and Grounds Fund and $210,000 is for hospital
parking.
• In the Building and Grounds Fund School Buildings Department, expenditures are expected
to exceed their budget by $50,000.
• A new department entitled School Building Major Maintenance is created and budgeted at
$12,000.
• In the Womens Bay Road Service District expenditures have already exceeded their budget
by $6,006.
• In the Bay View Road Service District expenditures have already exceeded their budget by
$4,670.
• The Borough needs to amend the debt service budget to account for the refunding of the
1998 bond issue.
• The Borough wishes to close these completed projects at the end of FY2009 and this
ordinance moves the unexpended funds to other projects.

the Borough Conference Room. The next regular meeting is scheduled on Thursday,
June 18, 2009 at 7:30 p.m. in the Borough Assembly Chambers.

15 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND

18 Section 1: This ordinance is not of general application and shall not be codified;

20 Section 2: The following sums of money, or as much thereof as may be authorized by law,
21 as may be needed or deemed necessary to defray all expenses and liabilities of
22 the Kodiak Island Borough, be and the same, is hereby appropriated for municipal
23 purposes and objects of the Kodiak Island Borough and other taxing entities
24 hereinafter specified for the fiscal year commencing on the first day of July 2009
25 and ending on the thirtieth day of June 2010;

27 Section 3: Adoption of this ordinance recognizes that funds are appropriated at department
28 and /or project level. Compositions of these figures are as delineated in the full
29 detail budget document. The full document is available to all elected and
30 appointed officials for their use. Copies may be reviewed by interested citizens at
31 the Borough Building during normal working hours and also at the A. Holmes
32 Johnson, Chiniak, and village public libraries during their normal operating hours
33
34 Section 4: Tax Levy. A tax for the amount specified in the form of a mill levy is hereby levied
35 for the value as of January 1, 2009, to be used for the purposes as specified in
36 the Budget for the Fiscal Year 2010 of the Kodiak Island Borough commencing on
37 the first day of July 2009 and ending on the thirtieth day of June 2010 to defray
38 expenses and liabilities of said entity as enumerated in the applicable budgets.

This memo includes responses to requests for information from the Mayor and Assembly on
the substituted budget.
We have moved $35,000 from Dept. 190, Education, Culture and Recreation to Dept.185,
Health and Social Services. While the budgeted funds can easily be moved from one
department to the other it was felt that increasing Dept. 185, Health and Social Services, was
more reflective of the Assembly's intent.
The budget for Dept. 190, Education, Culture and Recreation was changed by moving $12,000
for the school crossing guard program, $5,400 to the Northstar PTA, and $20,200 for the Karluk
IRA to their own line items and not including them in the Funding for non - profits line item.
The budget for Dept. 190, Education, Culture and Recreation was also reduced by moving the
request for the Dig Afognak program (4566), Historical Society — Baranov Museum ($5,500) and
the Maritime Museum ($1,500) to the Tourism Development Fund.
