Stephens, II ko--( 512' RE: Work session of December 27 DATE: December 27, 2007 I ask that the following be considered at the work session of the Borough Assembly scheduled for this evening, December 27, 2007. I understand that at this work session the assembly will interview applicants for the recently vacated assembly seat held up until December 6 by Sue Jeffrey and that Ms. Jeffrey herself has applied to be appointed to that vacancy (which was created due her having missed one -half of the regular meetings of the assembly from March through August of this year). Because Ms. Jeffrey obviously feels that the assembly is authorized to appoint her to fill a vacancy resulting from her own failure to abide by the attendance requirements of the Borough Code, I feel it appropriate to ask why she didn't simply resign or otherwise express a willingness to have the assembly vacate her seat once it became apparent that, otherwise, the Borough would be faced with litigation over the matter. Furthermore, I feel it is relevant to ask what public arose from Ms_ Jeffrey's forcing litigation over her attendance record and whether the legal costs incurred as a result are felt to have been merited. Finally, because Ms. Jeffrey has claimed that she did nothing wrong in connection with the events which led up to the vacating of her assembly seat, I would urge the assembly to ask (a) what prevented her from simply coming back from fish camp to attend at least one of the two regular meetings in August and (b) why she felt justified in voting on matters dealing with whether or not her own seat should be vacated.
