INVOCATION Captain John Quinn of the Salvation Army. 2. PLEDGE OF ALLEGIANCE 3. ROLL CALL Recommended motion: Move to specifically excuse any Assembly members that are absent. KIBC 2.16.070.... the Chair shall cause the record to reflect the absence of the member, the REASON for the absence, and whether the absence is excused by the Assembly. 4. APPROVAL OF AGENDA AND CONSENT AGENDA All items listed with an asterisk ( *) are considered to be routine and non - controversial by the Assembly and will be approved by one motion. All items in yellow are consent agenda items. Recommended motion: Move to approve the agenda and consent agenda. Mayor Selby will read aloud the items on the consent agenda. All that is needed to remove any item from the consent agenda is the request of an Assembly member. Assembly member Abell would like to a switch the order of items 13.E.2 Executive Session - Attorney's Opinion Regarding Assembly Member Attendance and 13.E.3 Declaring Assembly Member Sue Jeffrey's Seat Vacant on the agenda. The standing rules or the order of business established by the assembly may be suspended by a two- thirds (2/3) vote to which the assembly is entitled, (2/3 vote ispmembers.) This motion is an incidental motion. It requires a second, it cannot be interrupted, debated, amended, and it requires 2/3 vote, which is 1.41. The first version is the ordinance from the October 4, 2007 meeting and second /substituted version with proposed amendments /revisions. The motion before you is to adopt the first version from the October 4, 2007 meeting. Attached on yellow paper is additional public correspondence received and asked to be read into the record. Staff Report — Manager Gifford. Recommended motion: Move to amend Ordinance No. FY2008 -07 by substitution with either option A or option B or however the Assembly proceeds. Open public hearing. Discussion is to FOCUS ONLY on the reason to reconsider the vote. Assembly member Lynch may declare a conflict of interest. If the motion to reconsider passes with a majority vote, the motion to authorize the Manager to execute Contract No. FY2008 -14 with Red Hook Construction, LLC of Kodiak, AK in the amount not to exceed $64,591 for the period of October 18, 2007 through June 17, 2008 is before the Assembly as if the original vote had not taken place. Election of Deputy Presiding Officer Mayor Selby opens the nominations — Nominations may be made by any member of the Assembly - a second is not needed. Move to nominate as deputy presiding officer. Mayor Selby closes the nominations. If only one individual is nominated, the recommended motion is: Move to cast a unanimous ballot for as Deputy Presiding Officer. ROLL CALL VOTE ON MOTION If more than one individual is nominated, Mayor Selby asks the clerk to distribute ballots, collect, and tally the ballots. Balloting continues until there is a majority vote and Deputy Clerk McFarland announces the Assembly member elected to serve as Deputy Presiding Officer. B.CONTRACTS — None. The work session scheduled for November 8 has been rescheduled to Tuesday, November 13, 2007 at 7:30 p.m. in the Borough Conference Room and the next regular meeting of the Assembly is scheduled on Thursday, November 15, 2007 at 7:30 p.m. in the Borough Assembly Chambers. SUMMARY: This Ordinance was first presented to the Assembly on September-20 and was advanced to public hearing on October 04, 2007. n October 4, 2 OQLa public hearing was held and the Assembly postponed action to November 1,2 . On October 11, 2007, this item was placed on the work session agenda and direction was given to staff to draft a substituted version with the proposed amendments /revisions from Assembly members. The use of these watercrafts adversely impacts habitat for fish and wildlife. 8.35.015 Prohibited Acts. No person may operate high -speed watercraft or otherwise operate a watercraft of any kind in a manner to create a wake on the water bodies stated in section 8.35.030 of this Chapter. 8.35.020 Exemptions. The provisions of section 8.35.015 shall not apply to the use of vessels responding to an emergency. 8.35.025 Violations and Penalties. A. Violations of this chapter shall be infractions, and each occurrence of a prohibited act shall constitute a separate violation. B. Over the last several summers we've seen an increase of boat and jetski traffic on the lake and some of it was very dangerous in the fingers of the lake. I appreciate the work of Barbara Williams and of all the assembly members at the previous meetings and I believe a good compromise was reached at the last work session that addressed this issue. But after that meeting, the Assembly refused to move ahead and pass the compromise! I understand your reluctance to ban motorized watercraft from Island Lake but the solution that was put forward was a fair compromise to all user groups. Please don't give in to a small group of vocal motorized users. I ask you to take the following points into consideration as you make your decision: • There is little disagreement that the current set of rules simply isn't working and something needs to be done. • Someone WILL get hurt if this issue is not addressed, it's only a matter of time. Must you wait until an injury or death occurs to take action? • The compromise allows the use of motorized watercraft but enforces a penalty when the rules are broken. • Allowing motorized use from noon to seven gives everybody an opportunity to enjoy the lake whether you like it quiet or loud. • I support the passing of this ordinance and encourage each Assembly Member to vote for it. I have been an Island Lake resident for 23 years. Our home is situated right at the main part of the lake where most activities take place. Our neighborhood has changed over the years. When our house was built around 1970 there were four cabins at the backside of the lake. Now there are twelve houses. The area was still used for hunting and camping, jet skis were not even invented and powerful outboards for recreation not very common. Now Island Lake has changed into a residential area. I believe all activities should be honored, but the use of this public resource should be allocated in a fair way to its user base. The needs of the residents should be considered. There are at least 64 lots around the lake, 54 have homes built on them. At this time only three lake resident families have been launching high speed watercraft from their homes. I am fully aware that there are other lake residents who would like to have the opportunity for their future use of motorized craft. Also the public access to Island Lake has enabled other motorized users from the community to utilize the lake. The large majority are non - motorized users with considerable less impact. Keep in mind that only one highspeed craft used intensely can monopolize the lake all day long and impact everybody else around. What's fun for a few comes at the cost of many others. As a public lake Island Lake is also used by swimmers, kayakers, people enjoying the park and many other fun activities. Let's not forget Camp Mueller, a unique opportunity for all kids of Kodiak to enjoy life at a lake: Camping, canoeing, leaming outdoor skills and more. I believe better regulated motorized use would help them in their efforts and also open up this recreational area for folks, that don't play here anymore as they consider the lake as chaotic and unsafe.Sunny days and water - temperatures are not just an issue for waterskiers and jetskiers, but for everybody that likes playing on and in the water. I support a compromise that gives motorized users Tuesdays, Thursdays and Saturdays and leaves the rest of the week for all other activities. This is not about Waning access to a public resource, but about limiting equipment four days a week. That would still give motorcraft users plenty of time to enjoy the lake and also give parents a chance to teach their kids safe motorboating. The "odd /even day" approach has proven to be confusing. Therefore fixed week days would simplify the rules and clarify them hopefully for everybody. Highspeed and highpower activities on this small lake are not compatable with any other use. Accidents have not happened recently because non - motorized users leave the lake as it becomes unsafe and unpleasant. It is time to pass reasonable rules before an accident happens. I have been following the whole process quite closely. We have been living at the backside of Island Lake for over 20 years. Our daughter and her friends have been growing up with a great variety of real clean, fun activities in and on the lake all year around: Swimming, rowing boats, paddling kayaks and canoes in the summers and iceskating, skiing and sledding in the winters. I can honestly say that our activities have often been impacted by skiffs, jet skis, fourwheelers and snowmachines. At times we really don't feel safe enough to be out there in or on the lake. Also the ex- haust fumes in the air and the noise can get pretty overwhelming, actually very un- pleasant and annoying. During motorcraft activity we avoid playing in or on the lake, sometimes we even leave our home to find a safer and more quiet "playground" (for example Abercrombie Lake). 1 know there are many more people living around the lake and elsewhere in the community who feel very similiarly. From some of them you hear, from others you don't. I would just like to urge you to consider that the majority enjoys Island Lake without any motorcrafts. After listening to the last meetings on the radio I would like to address a few important things: 1. A clean fun activity in my book is an alternative to using a noisy, air and water polluting motorcraft. For example simple swimming, rowing or paddling a boat, watching a great variety of wildlife, iceskating, skiing, sledding, etc. Out of my experiences there can certainly be Tots of happy kids' laughter without the use of any motorcrafts. 2. It has been said several times that there have not ever been any accidents. Now that is simply not true!!! I would like to remind you that there have been at least one serious accident that I know of and who knows how many close calls. Just to mention two incidents: I never thought I would have to go back and bring this up again. Our daughter and I almost got run over by a skiff pulling a water skier. We were crossing the lake in our row boat years ago (at the time when we didn't have road access) and this skiff with a spotter in the bow - looking the wrong way!!) - came towards us full speed. If I wouldn't have jumped up and waved and screamed like crazy who knows what would have happened. Then there was this serious accident that I haven't heard anybody mention: A young jet skier lost control and raced right up on to Brian and Kristin's Johnson's dock full of playing kids. It was a miracle that none of them got seriously injured. After that accident the motorcraft problem got brought to your attention for the first time. Definitely this summer the use of motorcrafts has gotten way out of control again. It reminded me of the time before the "Lake Rules" got created by the Task Force. After dealing with this ongoing problem for so many years no wonder the wish for no motorcrafts at all has come up. But since everybody knows each other around here there has to be a more compromising solution. I feel very strongly there has to be a change before a real serious accident will happen and before a very tolerant majority of Island Lake residents and Kodiak community members will finally run out of patience. Performance and Payment Bonds In the event of any conflict or inconsistency between any of the foregoing documents, the conflict or inconsistency shall be resolved upon the basis of the numerical order. The document or documents assigned the small number or numbers being controlling over any documents having a larger number in the numerical order set forth above. Provided, however, although the supplemental conditions incorporates standard specifications by reference, in case of conflict or inconsistency, the standard specifications have a numerical order as shown above. The Contractor further covenants and agrees that all of said materials shall be furnished and delivered and all and every of the said labor shall be done and performed, in every respect, to the satisfaction of the herein aforementioned Borough Manager, on or before June 17, 2008. It is expressly understood and agreed that in case of the failure on the part the Contractor for any reason, except with the written consent of the Borough Manager, to complete the furnishing and delivery of said materials and the doing and performance of the said work before the aforesaid date, the party of the first part shall have the right to deduct from any monies due or which may become due the Contractor, or if no monies shall be due, the party of the first part shall have the right to recover One Hundred Dollars ($ 100) per day for each and every calendar day elapsing between the time stipulated, and the actual date of completion in accordance with the terms thereof: said deduction to be made, or said sum to be recovered not as penalty, but as liquidated damages. Provided, however, that upon receipt of written notice from the Contractor of the existing causes over which said Contractor has no control and which must delay the completion of said work, the Borough Manager may at his discretion, extend the period herein before specified for the completion of the said work, and in such case the Contractor shall become liable for said liquidated damages for delays commencing from the date on which said extended period shall expire. The Contractor hereby agrees to receive the prices set forth in the proposal as full compensation for furnishing all the materials and labor which may be required in the prosecution and completion of the whole work to be done under this contract, and in all respects to complete said contract to the satisfaction of the Borough Manager. It is further distinctly agreed that the said Contractor shall not assign this contract, or any part thereof or any right to any of the monies to be paid him hereunder, nor shall any part of the work be done or materials furnished under this contract. Evidence of the following insurance Policies will be furnished to the Owner prior to execution of the Agreement. These endorsements must provide thirty (30) day prior notice to the Borough in the event of cancellation, non - renewal or a material change in the policy. Proof of insurance is required of the following: A. Workers' Compensation Insurance The Contractor shall provide and maintain, for all employees of the Contractor engaged in work under this Contract, Workers' Compensation Insurance as required by applicable state law (A.S. 23.30.045) for all employees to be engaged in work at the site of the project under this Agreement. This coverage must include statutory coverage for States in which employees are engaging in work and employer's liability protection not less than $100,000 per person, $100,000 per occurrence. B. Comprehensive (Commercial) General Liability Insurance The Contractor shall procure and maintain, during the life of the Agreement, public liability insurance and contractual liability. The minimum acceptable limits of combined single limit coverage shall be in an amount not less than two million ($2,000,000) dollars per occurrence and annual aggregates where generally applicable. This action will show (in light of current issues) that the Board's intent has not changed and their desire remains that first responder services be provided by the Bayside Fire Department personnel. Feels that in the interim something else can be done; it is inappropriate and inadequate. [Memo stated that the Borough does not currently have the power to provide emergency medical services under the KIB code. Employees /volunteers told not to provide any such services. Employees /volunteers not covered by the Alaska's Good Samaritan Statute.] HIMES told the Board that Gifford was in the process of reworking the memo, which the Volunteers refused to sign. DOLPH read a mock article, detailing possible events should the memo remain in effect. ARNDT strongly recommended that the Chair or Vice Chair be present at every Assembly work session /regular meeting, because things come up that are not on the agendas and it could pertain to this issue. Board members are encouraged to attend the meeting at 9:30 a.m. Thursday, July 19 — Borough Assembly holding a special work session at 7:30 p.m. followed by a special meeting. Topic will be the "Borough EMS Powers" and a plan formulated to get the subject on the October ballot. Everyone is invited to attend. Presented a memo to the Assembly from R. Gifford outlining the options the Borough has to add "EMS" to the existing services of the Borough. The first choice of the Manager would be to Add EMS to Existing Fire Protection Service Areas, which would require a majority vote of the voters in each of the three service areas currently providing fire protection services. This would include a contract with the City to provide ambulance services but would provide the Borough the right to offer "First Responders" services throughout the three service areas. Further discussion held and clarification of information given to the Board members. VII. Open Issues a) Cossette House Removal/Disposal — Action Item It was MOVED, ARNDT and seconded to award to TC Enterprises for Fire Protection Area to pay in the amount of $7860 the job to remove and dispose of the Cossette house (4815 E. Rezanof Drive). DAVIDSON asked that the Board get a date certain of when the removal /disposal will be complete. ARNDT said there would be no problem to work with the contractor to have the house removed by September 30. The Board concurred with the deadline. Motion CARRIED. b) Fire Chief Job Description — Action Item It was MOVED, DAVIDSON and seconded to adopt the revised Fire Chief Job Description. Board concurred to add to Certificates, Licenses, Registrations so that it reads, "Requires State of Alaska certification as an Emergency Medical Technician I (basic), and Firefighter I or equivalent." Also "Alaska" was stricken from the first sentence so that it reads, "Must possess a valid driver's license." Motion was AMENDED, DAVIDSON to include "with changes on page 2 of 4 to Certificates, Licenses, Registrations." Amended motion CARRIED. Main motion CARRIED. DAVIDSON raised the issue of housing for the new apparatus. Options were discussed and Board decided to add this to the next work session. Motion CARRIED. b) MB Ordinance FY2008 -05 Review and Discussion Chair DOLPH presented information to the Board outlining the action that could be taken should the option be taken of including the EMS issue on the October ballot. The Assembly is to have the 2 " reading of Ordinance FY2008 -05 at the upcoming meeting, August 16, 2007. DOLPH stressed to the Board the importance of sharing their desire to add "First Responder EMS" only to the ballot. He provided an outlined breakdown of which way different votes could go and the various outcomes with the City once the votes had been cast and a decision was made. The Board concurred that public education of the issue was important; knowledge that the FPA Board was not looking to impact or raise the service area mil rates or budget is foremost. OLD BUSINESS 9/25/2007 Parks & Recreation Committee Meeting Minutes OCT A) 2008 CIP List • Womens Bay Jack & Lee Lakes Trail Management • Russian Ridge Forest Trails Cassidy stated the nomination form was put on the Borough website and we advertised in the local newspaper for CIP project nominations for Parks & Recreation. Two project nominations were received; one from David Heuman, who nominated the Womens Bay Jack & Lee Lakes Trail Management, and he provided pictures; and another from Hans Tschersich, who nominated the Russian Ridge Forest Trails, which he has identified the trails. Cassidy said he will have our mapping technician go out to identify these trails with GPS points and include steep slopes, unstable soils, and things like that. He will bring the CIP List to the next meeting and formalize the list that will be passed on the Planning & Zoning Commission. FOSTER stated he found it interesting of why they would want the Womens Bay project because it is already out of the city, and their back door is a recreational use. As far as the CIP's, what are we trying to develop out there? It's already a Natural Use area with hiking trails. The proposal TSCHERSICH submitted is closer to the city. We are trying to get kids to walk to school and get more activity out of people so these trails are ideally suited for the people who live in town. FOSTER is more inclined to this proposal because it is in the metropolitan area and it just makes more sense compared to something that is already out in the wilderness. TSCHERSICH stated he is often stymied walking through boggy trails. COMMITTEE MEMBER HUNTLEY stated it appears Heuman's proposal is anti -ATV. He said 25 years ago people were taking trucks and 4 wheel drive vehicles in there. It is so much better than it was. The idea of excluding ATV's and saying everything else is allowed is not right. Cassidy said it is zoned Natural Use area. We aren't talking about natural use in a sense; it's a zoning district that prohibits. If there is an area that's been identified as a no ATV area then let's enforce it. CHAIR SIROFCHUCK reminded everyone that Heuman's nomination is for a trails management plan. He will call to invite Heuman to the next meeting. NEW BUSINESS A) Island Lake Creek Bridge Construction Cassidy stated this is the grant agreement for $48,000 to use for the Island Lake Trail Upgrade. The lower bridge has fallen apart and it's been removed. A new bridge will not have to be built to ADA standards or engineer stamped. We could spend a lot of money engineering a bridge and bringing in large equipment to set it or another option would be to work with a non - profit to build a bridge. We could save a lot of money coming up with a State Parks design or something less than a full engineered bridge. COMMITTEE MEMBER SCHOEDER said he knows an Eagle Scout who is looking for a project. He's not sure if the scouts will be willing to take this on, but SCHROEDER will talk to him. SIROFCHUCK stated with community involvement then there is community ownership. SCHROEDER said they will have to vote on it but he knows there is interest. 9/25/2007 Parks & Recreation Committee Meeting Minutes Page 2 of 4 COMMITTEE MEMBER FOSTER suggested pursuing local contractors that might donate their time and equipment. COMMITTEE MEMBER SCHOEDER stated if there is a non - profit involved, any contractor that donates services can use it as a tax write off. Cassidy stated that having just walked the trail, one of the fallen trees that spans the creek is in pretty bad shape, and it's starting to bow and crack. You have to walk underneath it, so part of the project will be cutting that down. B) Non - motorized boats on Island Lake Cassidy stated this is appropriate for the P &R to be involved due to it being a recreational item, but if the Assembly approved it then it will be law. He feels it will be directed to a committee. He doesn't know if it will go to the Island Lake Task Force or who. CHAIR SIROFCHUCK inquired why it didn't come to Parks & Rec. As an advisory board he felt it should come to the committee first. COMMITTEE MEMBER FOSTER stated this is clearly a Parks & Rec issue. What is the borough asking us to do because we haven't received a lot of direction from them regarding a clear definition of what we are to be working on? If this isn't directly in line with what we were chartered to do he doesn't know what is. CHAIR SIROFCHUCK asked Cassidy to communicate that to the Assembly. Cassidy stated he would add the Parks & Rec Committee of 2007 has support and made your own path. In 1999 he thinks the committee didn't even have staff support. COMMITTEE MEMBER HUNTLEY asked who our Assembly representative is. SIROFCHUCK stated our rep is Chris Lynch. It was the consensus of the committee that they wish to take on the issue of watercraft on Island Lake, and to let Cassidy run it up the pole. Cassidy stated the biggest thing that came out of the task force was the rules of the lake. There were motorized and non - motorized people at the meeting. COMMUNICATIONS There were no communications. REPORTS A) Meeting schedule: • October 9, 2007 regular meeting at 7:00 p.m. in the KIB School District Conference Room. • October 23, 2007 regular meeting at 7:00 p.m. in the KIB School District Conference Room. SCHROEDER stated the Island Trails Network will be meeting the first week in October where they will discuss the Island Lake Creek Trail. COMMITTEE MEMBER'S COMMENTS SCHROEDER said he is glad to see trails on the CIP List. JUENGER said it's good to have more members back again. FOSTER is happy. SCHROEDER said Lori Demi was at Portage Trail helping lay geo- block. This is Koniag's project and they are building world class trails. We laid 1300 feet of geo- block. He has also been spending time screwing geo -block together for the Summit Lake Trail Project. SIROFCHUCK thanked everyone for all their hard work. He also said the Natives of Koniag are talking about wanting to sell Swampy Acres and Boy Scout Lake. ADJOURNMENT CHAIR SIROFCHUCK requested a motion to adjourn.
