TITLE:
Resolution No. FY2008 -08 Moving Money from Undesignated Projects in Fund 410,
Borough Capital Projects to the Kodiak Middle School Asbestos Abatement Project, the
Main Elementary Asbestos Abatement Project, and the Kodiak High School Soil
Remediation Project.
SUMMARY:
This resolution establishes three projects and funds them with a transfer from undesignated
Projects. These three projects will cost $388,000. There is $739,254 available in undesignated
projects.

MOVING MONEY FROM UNDESIGNATED PROJECTS IN FUND 410
BOROUGH CAPITAL PROJECTS TO THE KODIAK MIDDLE SCHOOL ASBESTOS
ABATEMENT PROJECT, THE MAIN ELEMENTARY ASBESTOS ABATEMENT PROJECT,
AND THE KODIAK HIGH SCHOOL SOIL REMEDIATION PROJECT
WHEREAS, the Kodiak Middle School has significant issues with asbestos and needs
$155,000 to abate this hazard; and
WHEREAS, the Main Elementary School has significant issues with asbestos and needs
$43,000 to abate this hazard; and
WHEREAS, the Kodiak High School oil tank, located under the parking lot, developed a leak
and contaminated the soil under the parking lot and needs $190,000 for clean up: and
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
1. New project 08001, Kodiak Middle School Asbestos Abatement, will be established in
Fund 410. $155,000 will be moved from undesignated projects to this project.
2. New project 08002, Main elementary Asbestos Abatement, will be established in Fund
410. $43,000 will be moved from undesignated projects to this project.
3. A new project 08003, Kodiak High School Soil Remediation, will be established in Fund
410. $215,000 will be moved from undesignated projects to this project

REQUESTING THE NORTH PACIFIC FISHERY MANAGEMENT COUNCIL
TO EXTEND THE EIGHTEEN MONTH REVIEW FOR THE
BERING SEA CRAB RATIONALIZATION PROGRAM
WHEREAS, Kodiak has consistently ranked among the top three fishing ports in the nation for
decades; and
WHEREAS, the harvesting and processing sectors of the Kodiak fishing community are
engaged in and dependent upon Bering Sea /Aleutian Islands (BSAI) crab fisheries; and
WHEREAS, Kodiak's economic and social health is dependent upon the community's sustained
participation in the BSAI crab fisheries; and
WHEREAS, the Kodiak Island Borough has made substantial investments in support of and in
reliance upon Alaska's fisheries, such as water system improvement and expansion and port
and harbor improvements and expansion; and
WHEREAS, the North Pacific Fishery Management Council adopted the BSAI Crab
Rationalization Program and allocated exclusive harvesting and processing privileges; and
WHEREAS, the BSAI crab fisheries have been managed under the BSAI Crab Rationalization
Program for two crab fishing seasons, and has promoted consolidation in the fishing fleet and
the processor sector, which resulted in skippers, crew members and processing workers bearing
costs of consolidation without fully sharing in the related benefits; and
WHEREAS, the BSAI Crab Rationalization Program changed the distribution of fishing revenues
among participants with resulting disruptive effects on the economy of Kodiak and other
communities; and
WHEREAS, the BSAI Crab Rationalization Program has resulted in disruptions in the processing
sector such as the sinking of the Stellar Sea that left harvesters linked to the Stellar Sea without
a market;
WHEREAS, other issues have surfaced that have not been addressed with proposed changes
such as custom - processing, crew shares, mergers, and processor participation; and
WHEREAS, the City of Kodiak and the Kodiak Island Borough joined together to appoint a
Kodiak Fisheries Advisories Committee to provide a forum for the full, and frank exchange of
information and opinions concerning changes in the management of the fisheries affecting
Kodiak; and
WHEREAS, this committee has not had adequate information on any proposed changes to the
BSAI Crab Rationalization Program to have public discussions and develop solid input to the
decision - making process.

The Kodiak Island Borough is hereby requesting that the North Pacific Fishery Management Council
(NPFMC) extend the 18 -month review period for the Bering Sea Crab Rationalization Program. Our
primary basis for this request is that we anticipated there would be proposed adjustments to this
program that would be subjected to public review and council staff analysis. We have not had an
opportunity to participate in this discussion.
In addition, the Kodiak Fisheries Advisory Committee was established this past summer by the
Kodiak Island Borough Assembly and the City of Kodiak Council as an advisory body for the
community on fishery issues that will have an impact on Kodiak. The group consists of 20 individuals
from all user groups in the community.
The advisory committee has held two meetings since being appointed. The most recent meetings
were held on Thursday, September 20. The members spent a significant amount of time discussing
the October North Pacific Fishery Management Council meeting and issues on the agenda.
The advisory committee intends to plan future meetings and address issues that will be before the
NPFMC well in advance of planned Council action. They will present recommendations to the
Kodiak Island Borough Assembly and Kodiak City Council with sufficient time before proposed
NPFMC action in order for the Assembly and City Council to develop recommendations and to
present testimony and public comment at your meetings.
The one issue that has come forward is the issue listed on your agenda as C -3 — BSAI Crab Fishery
Management, item (B). As you know the crab advisory committee formed by the NPFMC has held
several meetings regarding the "B" shares in the crab rationalization program. They have tried to
determine whether they have been used as the Council intended. It is the understanding of the
Kodiak Fisheries Advisory Committee that the NPFMC Crab Advisory Committee members are not
in consensus on this matter. As a result, we would ask that this item be carried forward to the
December meeting to allow the public to be involved before the decision is made.

Other issues that would indicate a little more time should be spent on the Being Sea Crab
Rationalization include:
The Kodiak Island Borough is requesting that the NPFMC continue the analysis of the issues
surrounding the 90/10 processor share provision and extend the 18 -month review period for the
Bering Sea Crab Rationalization Program. There are important questions still to be answered and
we are requesting the opportunity for involvement and input to these important issues.

some of whom live in Kodiak.
c. The fact that Unisea did not apply for their golden king crab IPQ this year.
d. Concerns regarding the pending merger between Maruha and Nichiro and impacts to
the community of King Cove and crab harvesters that have sold product there in the
past.
e. Concerns with the need for continuing analysis of the issues surrounding the 90/10
processor share provision.
