2008-04-19 Work SessionKodiak Island Borough Assembly Work Session Saturday, April 19, 2008, 9 a.m., Borough Conference Room Work Sessions are informal meetings of the Assembly where Assembly members review the upcoming regular meeting agenda packet and seek or receive information from staff. Although additional items not listed on the work session agenda are discussed when introduced by the Mayor, Assembly, or staff, no formal action is taken at work sessions and items that require formal Assembly action are placed on regular Assembly meeting agenda. CITIZENS' COMMENTS (Limited to Three Minutes per Speaker) ITEMS FOR DISCUSSION 1. Borough Land Management MANAGER'S COMMENTS CLERK'S COMMENTS MAYOR'S COMMENTS ASSEMBLY MEMBERS COMMENTS Page 1 of 1 Borough Land History Land Management- State Entitlement Lands 4 -18 -08 1. A land base was one of the carrots that got Kodiak to organize as a regional government (Borough). 2. Borough was allowed to select 10% of the "vacant, unappropriated and unreserved" (VUU) land (much of Kodiak is reserved as the Kodiak National Wildlife Refuge). 3. Borough started to select land at the same time as the Native Claims Settlement Act. Native Corporations were given first selection rights. 4. Borough selected parcels all around Kodiak Island because of pending oil and gas development. Upland sites in bays where shore side development might occur. 5. State rejected many of the parcels that KIB selected. • Resulted in a court case & Out of Court settlement that specifically identified our selections. • Much of the land KIB selected, were also attractive to Native Corps (Kaisin & Middle Bay etc.) Under federal law Native Corps had first selection rights 6. KIB is entitled to 56,500 acres of State owned Land • We have management authority over the land selected • But need to survey the exterior boundary to receive title. 7. We have "Over Selected" — and have a theoretical amount, but until land is surveyed, it is only an estimate — But we can only end up with 56,500 acres What has the Borough done with its lands? 1. Sold a lot of it. • 26,000 acres of it was sold to EVOS Trustees for $40,000,000 (ish) • All private land sold for residential and business Sargent Creek and Russian Creek Subdivision in Womens Bay was land KIB disposed of at Borough land sales. • Much of the land in town — a. Service Area #1 (outside the city limits) b. Monashka Bay land c. with the exception of certain homesteads (Island Lake, Mill Bay Beach Area, Part of Woodland Acres, Monashka Bay) • Parts of Chiniak, Kupreanof Straits, Raspberry Straits, and Onion Bay etc I KIB land. • It is a multi- million dollar asset — A good definition of Borough lands is that it is "Trust Lands" 2. Put into public use • Monahska Bay Watershed - Critical to the community for homes and for seafood processing I Borough land. • Terror Lake Hydroelectric Plant and support structures 3. Trust Lands /Land Management • Public land is not only valuable for not only for land sales, but for public recreation, and land trades (for valuable private land that is valuable for public purposes). • Future needs that we can't identify as of yet. • Valuable habitat land — Raspberry Island Land (8,000 acres) valuable Elk Habitat and valuable public hunting lands • Valuable for disposal to generate money that can off-set taxes. • Revenue from sale of Shuyak Island has had great implications to keeping property tax low, help construct public infrastructure, build an endowment. It remains open to the public for recreation etc. What may be coming down the road? 1. Resolution of the Leisnoi /Stratman land issue. • Land will be sold along the Chiniak Highway (Power /paved roads/ demand for second homes ) • Interest KIB land ownership of the historic Leisnoi village site on Woody Island. • Interest in acquiring lands along the road system currently in private hands - for public purposes: Access to fishing, camping, and overall recreating. • Overall demand for hunting. A lot of former popular hunting areas may be closed to trespassing • Increase demand for non - consumptive recreational uses (hiking, photography etc) • Public land value may be to keep a lot of it public — need to determine that there isn't a short term nor long term public need prior to disposing. 2. Increased Recreational demands Borough Land Sales 1. There is a new paradigm for selling /subdivision lands. Not just KIB owned land but private land as well. I have heard it at all levels • Parks and Recreation Committee • Planning and zoning Commission • At the Assembly level 2. Development with Amenities URBAN AREA • Water and Sewer - • Paved Roads • Connected to existing bike trails and area parks • Underground utilities (i.e. Street lights, power • Larger Lot size than the 7200 square feet that the code now allows • Recreational amenities RURAL AREAS • Larger lot for functioning septic systems & sufficient water supply 3. Move to sell large chunks to Developers vs. KIB subdivided and sold properties. • The risks of developing and marketing land are a private sector function • Governments role is to provide the infrastructure understand the public's needs for land disposal rules and regulation. 4. How to do that: • Many code changes (from the zoning code to the subdivision code to the Borough Lands Code) • A lot of input of the committees, Commissions and Assembly • Competitive Design ( ?) Areas of Interest for Borough land disposal 1. Kodiak Urban Area • Behind Beaver Lake — Urban development 1. High recreational value 2. A lot of steep slopes 3. Expense to connect to existing water and sewer lines could be substantial 2. Bells Flats — Rural development • Top of Marine Hill /Cliff Point Area 1. High recreation value (Heitman Lake) 2. Large lot residential (5 acres? 3. Chiniak — Rural Development Resurrect Chiniak Subdivision Another lot by the Tsunami center Chiniak School to close. Past Issues 1. Competitive with Private Sector Land Owners • Other landowners cite competition • Large landowners - Natives of Kodiak Energy Plus - Anderson Construction 2. Timing with the Market • Most private landowners cite market issues as reason for not developing at this time. • NOK — needs subdivision redesign, but on hold primary because of market issues Land Management Program 1. Resource Management position • I have been in charge of two of the Borough's 6 departments, and I can comfortably state that there is a lot on folks plates • It cannot be done with existing staff • Too many details in preparing a land sale • Work with surveyors, land title folks, state and local agencies • Recommend a resource manager 0 E a) N co a) N t o 4- 0.
