Javiert3MC RE: Teleconferencing Attached is the Ordinance regarding teleconferencing. Underlined in blue are the revisions as requested from the last work session. In number 2, I added verbage to allow Assembly members to notify the Clerk at least 24 hours if a member decides to travel and have not had the opportunity to inform the Assembly at a previous meeting. The Assembly also requested a cost estimate for tele - conferencing equipment. I was able to get information from GCI and ACS regarding teleconferencing which I think would be more cost effective and efficient. Attached is information and cost break down. What they offer is easier; Assembly members would dial a toll free number and enter a code to connect without the assistance of a conference representative. For out of country tele - conferencing, ACS and GCI offer different options with the help of a moderator. This would relieve the Clerk's Office Staff of the responsibility of re- establishing connection while running a meeting. FY 2007 -XX Introduced by: Assembly Requested by: Assembly Drafted by: Borough Clerk Introduced: Public Hearing: Adopted: AN ORDINANCE OF THE KODIAK ISLAND BOROUGH AMENDING KODIAK ISLAND BOROUGH CODE OF ORDINANCES TITLE 2 ADMINISTRATION AND PERSONNEL CHAPTER 2.17 RULES OF THE ASSEMBL SECTION 2.17.020 GENERAL RULES TO PROVIDE FOR TELECONFERENCING DURING ASSEMBLY MEETINGS WHEREAS, currently there is no provision in the Borough Code for assembly members to participate in assembly meetings by teleconference; and WHEREAS, Alaska Statutes 44.62.310 provides that attendance and participation at meetings by members of the governmental body may be by teleconferencing; and WHEREAS, the assembly is desirous that assembly members be able to participate by teleconference during work sessions and assembly meetings: NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is of a general and permanent nature and shall become a part of the Kodiak Island Borough Code of Ordinances. Section 2: Title 2 Administration and Personnel Chapter 2.17 Rules of the Assembly Section 2.17.020 General Rules is hereby amended as follows: 2.17.020 General rules. A. Public meetings: All official meetings of the assembly shall be open to the public. The journal of proceedings shall be open to public inspection. B. Quorum: Four (4) members of the assembly shall constitute a quorum. C. Absences: No member of the assembly may absent himself from any regular or special meeting of the assembly except for good cause. An assembly member who is unable to attend a meeting shall advise the clerk or the mayor of the contemplated absence and the reason for that absence. During the course of the meeting from which the member is absent, the chair shall cause the record to reflect the absence of the member and whether the absence is excused by the assembly. D. Teleconferencing: Attendance and participation of members of the assembly at assembly meetings may be by teleconference. 1. Telephonic participation by assembly members is authorized during assembly meetings when an assembly member is physically absent from Kodiak or is physically incapacitated. The assembly member shall inform the assembly of his or her wish to participate by teleconference at a meeting or twenty four (24) hour notice shall be given to the clerk prior to the teleconference. 3. An assembly member participating by teleconference shall only be allowed if the meeting is held with a quorum of members physically present. 4. An assembly member participating by teleconference shall be deemed to be present at the assembly meeting and shall have the same right to participate in discussion and to vote on any matter as if physically present at the assembly meeting. The vote shall be conducted in such a manner that the public may know the vote of each person entitled to vote. All votes shall be taken by roll call vote. 5. An assembly member participating by teleconference shall not be charged for any telephone costs associated with the teleconference participation. 6. Participation from outside of Alaska is permitted. 7. If there is an unexpected severance of connection, a brief recess may be called to reestablish connection. If such efforts are unsuccessful, the action of the Assembly shall not be invalidated on which the teleconferenced member could have voted. 8. Reasonable efforts shall be made to ensure agenda packets and other materials are available to the members or at the teleconference location. Publication on the website prior to the day of the meetings may substitute for hard copies. E. Rules of order: "Roberts Rules of Order Current Edition" shall govern the proceedings of the assembly in all cases, unless they are in conflict with these rules. Box 521 Kodiak, Alaska 99615 February 23, 2007 Thank you for your kind words in regards to my dedication and support to the City of Kodiak as a volunteer serving on the Fire Department. I truly enjoy volunteering on the Fire Departments and it is nice to be recognized for the 13 years of service provided to the community since April 29 1994.When I joined the ranks of volunteer's in the community who park their cars in the their driveway's, With the grill facing the street ready to dashes out the door when the pager sounds off. For the sake of helping a neighbor's in need. I am somewhat concerned that the City of Kodiak feels it appropriate to dictate what organizations I can and cannot volunteer or belong with! Particularly my association as a volunteer with Bayside Fire Department has been called into question. I am referring to the letter, dated February 6, 2007, given to me by the current Fire Chief Andy Nault. For your review I have included a copy of his letter and a copy of his explanation. I am sure that my association with Bayside Fire Department is not illegal in nature. It is my understanding that I have the right to volunteer my services to any and all organizations that I feel is worthy of serving. The letter Chief Nault provided to me is clearly sending me a message that I must choose between Bayside Fire Department and the City of Kodiak Fire Department. I WANT to continue to offer my service to both organizations; unfortunately I have also been informed by the Kodiak city manger that if I can't makes a decision the city will make the decision for me. Well as of February 20 while ending my work shift I ran into City Fire Chief Andy Nualt. He asked if I had a minute? He told me that since he hadn't heard from me on my decision that he had wrote me a letter making my decision for me that I would no longer be a Kodiak City volunteer as of February 23 2007. In closing I would like to say I do not feel it is anyone's right to tell me or anyone who and what organization we can volunteer our service for, this is OUR free time that we are willing to giving to the community of Kodiak. Bayside has a structural fire. They request Mutual Aid from the City. The City responds and pages the reserves to respond to the City for other responses. A Member of both department would have to choose who he /she would respond with. If member chooses Bayside he /she would not be meeting the commitment to the City. If member chooses the City he /she would not be meeting the commitment to the Bayside Fire Department. If a member has to choose some fire department would be left expecting a member to help out yet he /she would not be available. The requirements that a member belong to only one department is very common through the fire service. The Bayside Fire Station encourages its members to expand their training and experience, and this includes membership or employment in other Kodiak fire departments. The Bayside Fire Station also encourages its members to participate in other organizations in order to expand their community participation to the extent they feel appropriate. Members who are employed by another fire department as their primary employment are expected to respond to the needs of their employer before the needs of the Bayside Fire Station. Members who volunteer for more then one department are expected to maintain attendance requirements for the Bayside Fire Station. When responding to calls, the member will be covered under the policies and procedures of the department that he /she responds with, and shall fall under the control of that department's chain of command. For example, if a member of Bayside responds to a call on a Bayside apparatus he/she shall be considered a Bayside member, whether the response is within Fire Protection Area No. 1, the City of Kodiak, Coast Guard Base, or Women's Bay. And conversely if that member responds to a call on a City of Kodiak apparatus he /she shall be considered a City of Kodiak member.
