Contract No. 2004 -49 EVOS Scrap Metal Removal from Karluk.
The EVOS grant that the KIB has entered into with the Trustee Council /DEC expires
tonight. At that time all contracts for work under the grant must be approve. The work
does not have to be done; just the authorization or contracts need to be in place.
Staff has been working with the communities of the borough for the last 5 or so years to
remove hazardous material from the villages. We have succeeded in some area like the
removal of batteries from the community landfills, purchase and installation of used oil
burners - to burn crankcase oil from vehicles and vessels as well as community
machinery, and burn boxes to efficiently burn the community's garbage etc. We have also
work with them to remove fluids and crush the thousands of 55 gallon drums found in the
villages. Vehicle oils, gas, brake fluids, rear end gear lube and antifreeze has been removed
from derelict cars and trucks. What remains is the removal of this scrap metal.
Staff has entertained any number of proposals to remove the metals. We have
contacted or been contacted by any number of transport companies, barge
company's, representatives of barge companies, folks with a boat, but for one
reason or another (sometimes the issue was proper insurance, or the logistics of
picking up metals in Karluk or Port Lions pr the small quantity of metals see Tracy
Mitchell September 27,2004 memo for more history.) We have recently received
two proposals to remove the metals that have merit and have been approved by
DEC and Trustee Council.
The Borough Assembly must approve these proposals because they are outside of
KIBC 3.16.010 (contracts that can be enter into by the Borough Manager)
Staff recommends a contract to remove metals from Karluk be entered into with
West Bay Corporation, M/V Cape Douglas in an amount not to exceed $20,000.

INTRODUCTION
You have on your agenda the approval of contracts to remove metals stockpiled in Karluk and
Port Lions. These projects are part of the EVOS grant that expires tonight at midnight. At that
time we are required to have all contracts and approvals completed if they are to be reimbursed
by the Trustee Council. That means that the work does not have to be complete, but the
contracts /approvals have to formally be in place.
Staff has been working hard the last two weeks to put in place things needed for villagers to
work on the preparation of metals for eventual removal. Purchases such as personal protection
gear, drum deheaders, oil /water separators, or drum crushers are either completed or in process.
Staff has also been working on the transport of these metals out of the villages. We have
contacted the following transporters, Lazy Bay, Cape Douglas, Samson Tug and Barge, Horizon,
Alaska Marine Transport, and the MV Helinke B (out of Homer). We have been contacted by
any number of barge companies that have done work in Ouzinkie and the other villages as well
as by other barge companies that are passing by Kodiak on their way to Seattle. (See Tracy
Mitchell' Agenda Statement for more history.)
RESPONSES
We have had few firms who were willing to perform such a task because of the nature of getting
and out of .dares like Karluk and Port 1inns
We did receive two quotes: one from Doug Pederson with the M/V Cape Douglas and the other
from the Robert J. Barge Company of Homer but with local representative, Gary Abston. These
quotes are as follows:

BOROUGH CODE
The authority to approve these contracts is not found within the Manager's authority. His
authority is found in KIBC 3.16.010 and specifically lays out the scenarios in which he can or
cannot enter into contract. These projects fall outside of his authority.
The need to advertise for such work as required under KIBC 3.16.040 is not required because
that need is for contracts over $25,000 and for the types of projects authorized by 3.16.010.
Again this project does not fall under the types of contracts identified. Those specific contracts,
purchases and sale and transfer procedures are for the following:
A. Contract for purchase, or issue of purchase authorizations for all supplies, materials,
equipment, and services for the offices, departments, and agencies of the borough;
B. Sell surplus, obsolete, or unusable personal property for the offices, department, and
agencies of the borough;
C. Transfer suppli9es, material and equipment to or between the offices, departments, and
agencies of the borough; or
D. Contract for the construction, repair, or improvements of borough facilities.
My interpretation of this section of the code is that for this unique project —using EVOS money
(to reimburse the KIB) for work in the villages - it does not fall under KIBC 3.16.010.
Additionally, because the manager may only enter into contracts for projects and items found in
3.16.010, only the Assembly may approve contracts for metals removal from the villages.
RECOMMENDATION
It is recommended that contracts for removal of scrap metal be approved as follows:
• Approve a contract with Robert J Barge Company for scrap metal removal from the
community of Port Lions in an amount not to exceed $48,500.
• Approve a contract with M/V Cape Douglas for the removal of scrap metal from the
community of Karluk in an amount not to exceed $25,625.

Being able to compare "apples to apples" for scrap metal removal from the villages has proven to be a very
difficult task. Much research has been done to try and provide this service at a reasonable cost. Among
others I contacted the M/V Lazy Bay, the M/V Cape Douglas, Samson Tug & Barge, Horizon, Alaska
Marine Transport, M/V Helinka B out of Homer and asked Jim Ragsdale of Schnitzer Steel to try and
convince some of his barge contacts to come to Kodiak villages to remove the scrap. Either it was cost
prohibitive because the barge would have to be chartered or they were simply not interested in the project.
I was unable to obtain any firm numbers for loose barging the scrap all the way south because there wasn't
any interest from those that had the capability to do so.
In April a barge company out of Juneau - Channel Construction contacted me. They provided me with a
cost estimate of $8500 and would barge the scrap to Seattle. Channel Construction was unable to come to
Port Lions to conduct the work until September 3, 2004. Upon their arrival they determined that their barge
was too big and that it would not be possible for the scrap metal to be removed.
There are approximately 50 -75 tons in Karluk and 250 tons of scrap metal to be removed from Port Lions.
Mr. Peterson, with the M/V Cape Douglas estimated that the cost to remove the metal from its location in
Karluk and Port Lions, ship to Kodiak and transport to the Kodiak Island Borough Landfill for shipment
off island would be $20,000 and $41,968.25 respectively. The costs to accept the metal into the Borough
landfill are estimated to be $5625 and $18,750 respectively.
Another barge company — Robert J. Barge Company out of Seward, has recently contacted me. They are
also interested in removing the scrap metal from Karluk and Port Lions but shipping it south to Seattle.
This means the Kodiak Island Borough will not have to handle and manage the scrap to ship off island.
Their estimates are $35,000 for Karluk and $48,500 for Port Lions.
Scenario 1) M/V Cape Douglas
Karluk = $20,000
Port Lions = $41,968.25
Kodiak Island Borough Landfill $75 /ton x 75 tons = $5625
Kodiak Island Borough Landfill $75 /ton x 250 tons = $18,750 (residential rate used)

Scenario 2) Robert J. Barge Company
Karluk = $35,000
Port Lions = $48,500
Total = $83,500
It is recommended that approval be given for the expenditure to Robert J. Barge Company. Their reduced
cost has another advantage of not having the metal come into Kodiak, the Kodiak Island Borough's landfill
and managed for shipment off island.

Hi Tracy,
It was great talking to you earlier regarding the scrap
projects in your area. We would like to present a bid to take
on the scrap project going on in Karluk. It is estimated to
be about 50 -75 tons of materials maximum.
Our proposal would involve us mobilizing the proper
heavy equipment to move the scrap from the village site in
Karluk to the barge landing (or be responsible for that

movement) and the proper barge necessary to accommodate
the move of the materials away from the Karluk area at
which time Robert J Barge Company, owned by John
Charles Eads of Seward Alaska, an Alaskan Native, will
become owner of the materials and be responsible for the
materials as an asset or liability. The proposed cost to your
agency would be $35,000 payable to Robert J Barge
Company upon their departure out of the Karluk area.
Any materials not properly handled to meet general
requirements of scrap to be hauled, i.e. draining of fluid 's,
wiping of drums, etc. will be refused for shipment and not
part of a requirement to haul out of that village for full
consideration of our agreement. The shrink - wrapping of
any pallets of scrap, the emptying of any liquids out of the
equipment, removal of any freon or any hazardous
materials left over from the material, and any other costs
involved other than picking up and moving of scrap items
will result in added costs.
Please let me know if you have any questions regarding
this proposal to haul. We would be happy to adjust the
agreement to better serve your needs.

The Honorable Mayor LeDoux and Assembly Members,
This letter is in reference to the scrap metals removal in Port Lions. The
consolidation of the metals has occurred with the rubber tires and fluids
removed from vehicles and 55 gallon drums crushed and ready for shipment.
We are requesting approval of expenditures for the completion of this project.
In this day of budget cuts once this opportunity passes by we may never again
be in the position to finish this project, and we will have to contend with this
problem in our community for years to come.
As some of you know, we go to great lengths to keep our community as clean as
possible and the environmental and aesthetic issues associated with scrap metals

Re: Scrap Pick up Port Lions
Hi Tracy,
It was great talking to you earlier regarding the scrap
projects in your area. We would like to present a bid to take
on the scrap project going on in Port Lions. It is estimated
to be about 250 tons of materials.
Our proposal would involve us mobilizing the proper
heavy equipment to move the scrap from the village site in
Port Lions to the barge landing (or be responsible for that

movement) and the proper barge necessary to accommodate
the move of the materials away from the Port Lions area at
which time Robert J Barge Company, owned by John
Charles Eads of Seward Alaska, an Alaskan Native, will
become owner of the materials and be responsible for the
materials as an asset or liability. The proposed cost to your
agency would be $48,500 payable to Robert J Barge
Company upon their departure out of the Port Lions area.
Any materials not properly handled to meet general
requirements of scrap to be hauled, i.e. draining of fluids,
wiping of drums, etc. will be refused for shipment and not
part of a requirement to haul out of that village for full
consideration of our agreement. The shrink - wrapping of
any pallets of scrap, the emptying of any liquids out of the
equipment, removal of any freon or any hazardous
materials left over from the material, and any other costs
involved other than picking up and moving of scrap items
will result in added costs.
Please let me know if you have any questions regarding
this proposal to haul. We would be happy to adjust the
agreement to better serve your needs.

Approval of Election Workers.
Per borough Code:
7.30.010 Election officials.
A. The assembly shall appoint at least three (3) judges in each precinct to
constitute the election board of that precinct. The borough clerk is the election
supervisor. One (1) judge shall be designated as chair and shall be ordinarily
responsible for administering the election in that precinct. The borough clerk may
appoint up to three (3) election clerks at any polling place where they are needed to
conduct an orderly election and to relieve the election judges of undue hardship.
The election workers approved for Ouzinkie have been replaced by four new election
workers.
