1. Mike Anderson/Service District #1 - Request for Reimbursement of
Road Maintenance Costs
Mike Anderson explained his appeal of a Service District #1 decision to
charge him for road maintenance costs on Puffin Drive during the winter
months. He stated that he was in the process of subdividing his
property which adjoined Puffin Drive into residential lots. In order to
subdivide the property, he said he had to provide water and sewer lines
to the lots, and the main lines were located in Puffin Drive. He
started the installation of these lines last fall but could not complete
the project for several reasons. He said he paid the service district
maintenance contractor (Island Sand and Gravel Company) to grade and
compact Puffin Drive so it would be in good condition over the winter
months. No contract had been signed to maintain Puffin Drive, and he
said he was paying for all the improvements, which when completed, would
be given to the borough. He thought the borough should pay for the snow
removal and requested relief from the costs.
Tony Perez, representing Service District #1, stated that historically
all contractors who were subdividing property were responsible for
maintenance of all roads until the borough accepted the subdivision. He
said Puffin Drive was a part of the plat and, therefore, the subdivider
was responsible for the road. He stated it was a consistent application
of policy. He noted at the Service District meeting on March 14, 1989,
there were five members present - three members voted in favor of
Mr. Anderson (one vote being Mr. Perez's vote) and two members voted
against him - the motion failed to rescind the Service District Board's
decision.
A question and answer period followed among Mr. Anderson, Mr. Perez, and
assemblymembers. The decision was made to place the appeal on the
June 1, 1989 K.I.B. agenda.
2. Discussion with Assembly Attorneys
Both Mr. Jamin and Mr. Ebell were present to discuss with the assembly
the litigation resulting from the Exxon Valdez oil spill.

Mayor Selby reported on his recent meeting in Anchorage with mayors from
other oil- impacted communities, and the problems getting Exxon to sign
the municipal agreement about the advance funds issue and the
reimbursement of straight time for municipal employees. He said Exxon
deemed the agreement too broad. Mayor Selby said he told Exxon that

3. FY1990 Budget
Mayor Selby reviewed changes in the FY1990 budget. He said there would
be an increase in the State Revenue Sharing and Municipal Assistance of
approximately $53,000. He wanted to draw down on the Fund Balance and
to implement the Personnel Advisory Board recommendation to increase the
salary for several positions which would amount to approximately
$15,000. As a separate issue, a three percent salary increase to all
employees was discussed.
Changes suggested:
Department 143 - Borough Mayor
Add an Administrative Assistant /Personnel Officer (Range 20)
Department 148 - Engineering /Facilities
Combine the two departments
Add $20,000 to Contracted Services
Department 154 - Education Support
Delete 400,000 - Debt Service Fund
Transfer of $80,000 to Mental Health - Not in budget
Add:
Bike Trail Cleaning
Grade Pillar Mountain Road - Suggestion to ask city of Kodiak to grade
it since road is located within the city limits.

4. Other
Lonnie White relayed the Hospital Advisory Board's request for $13,000
to replace carpet in the hospital cafeteria and hallways. Also, Mr.
White requested a list of names and addresses of the new American
citizens who were recently naturalized so a letter of congratulations
could be sent to them.
Regarding the Felton Construction Company Suit over the hospital site
preparation, Mayor Selby stated it was Joel Bolger's opinion that the
borough send an "Offer of Judgment for $60,000" as settlement. The
assembly concurred and the mayor would make the offer.
