AUTHORIZING THE BOROUGH MANAGER OR HIS DESIGNEE TO COMPLETE THE
PURCHASE OF LOT 3, BLOCK 10, MILLER POINT SUBDIVISION, FIRST ADDITION
WHEREAS, Kodiak Island Borough Code Section 18.10.110(c) provides that the Borough
may acquire real property by negotiated purchase; and
WHEREAS, Kodiak Island Borough Code Section 18.10.020 provides that real property shall
be acquired pursuant to a resolution of the Assembly; and
WHEREAS, an appraisal report completed by the Assessing Department determined the
indicated market value of this property to be $27,500; and
WHEREAS, the Borough Manager negotiated with the property owner, pursuant to Assembly
approval, with both parties reaching agreement and signing a Contract for Sale of Real
Property for $27,500 with the Borough paying all closing costs; and
WHEREAS, acquisition by the Borough will forestall the large -scale blasting and rock removal
that would unavoidably be a by- product of short -term development of the property by a private
property owner; and
WHEREAS, acquisition by the Borough will allow for consolidation of this property with
adjacent Borough land, facilitating a more comprehensive, long -range development consistent
with previous Assembly determinations regarding disposition of the land;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
that in accordance with Kodiak Island Borough Code Section 18.10.020, the Manager or his
designee is authorized to complete the purchase of Lot 3, Block 10, Miller Point Subdivision,
First Addition for $27,500, consistent with the market value indicated in the appraisal report
dated April 27, 2003, with additional closing costs of approximately $500.00.
