SURPLUSING BOROUGH LAND ADJACENT TO NORTH STAR ELEMENTARY SCHOOL
AND AUTHORIZING THE BOROUGH MANAGER TO

WHEREAS, KIB Code 18.20.120 allows the Borough Assembly to authorize the Borough
Manager to negotiate directly with parties interested in acquiring Borough land; and
WHEREAS, KIB Code 18.20.060 allows citizens to apply for disposal of Borough land;
and
WHEREAS, KIB Code 18.20.090 allows citizens to bid for disposal of Borough land
subject to a development plan; and
WHEREAS, the Planning and Zoning Commission determined by resolution that certain
lands in Miller Point 1st Addition, adjacent to North Star Elementary School, are surplus
to the Borough's need;
NOW, THEREFORE, BE IT RESOLVED BY THE KODIAK ISLAND BOROUGH ASSEMBLY
THAT:
Section 1: That portion of those lands described as the western portion of Lot 1 A,
Block 6 Tying north of Lot 3, Block 10 and the westerly portion of Lot 1,
Block 9 of Miller Point 1st Addition, along with the Lilly Way right of way
in the area of North Star School, as depicted on the attached map are
surplus to the Borough's need.
Section 2: The Assembly, in accordance with KIB Code Title 18, authorizes the
Manager or his designee to negotiate with the applicant Clark Yatsik and
other interested parties in the development of the surplused area
pursuant to KIB Code Title 18 and submit to the Assembly for
consideration at a future date a formal proposal and development plan for
the surplused area referenced above including but not limited to the sale
of any adjacent lots created by the development plan.
