2001-52 Uyak Bay Release of PropertyKODIAK ISLAND BOROUGH RESOLUTION NO. 2001 -52 Introduced by: Manager Carlson Drafted by: Assessor Mould Introduced: 12/20/2001 Adopted: 12/20/2001 A RESOLUTION OF THE ASSEM L OF THE K DIAkinND BODY; G APPROVING THE RELEASE OF A PARCEL FROM PUBLIC PURPOSE CLASSIFICATION IN UYAK BAY WHEREAS, many owners of parcels within the boundaries of the Kodiak National Wildlife Refuge have lost their property through tax foreclosure; and WHEREAS,the Kodiak Island Borough filed a clerk's deed against the Olga McCormick ten -acre parcel located in Uyak Bay on February 3, 1994; and WHEREAS, the property is legally described as Fractional SW 1 /4 NE 1 /4 SE1/4 and E1/2 E 1 /2 SE1/4 NW 1 /4 SE1/4 of Section 22, T31 S, R29W, Seward Meridian, Located in the Kodiak Recording District, Third Judicial District, State of Alaska with a Kodiak Island Borough tax identification number of R5312922072231; and WHEREAS, pursuant to Ordinances No. 95 -05 and No. 95 -05A and Resolution No. 98 -24, the Assembly has made a determination that inclusion in the Refuge is a valid public purpose for the parcels and approved the sale of the tax foreclosure parcels to the U.S. Fish and Wildlife Service; and WHEREAS, the principal parties have agreed to a conveyance directly from Olga McCormick to the U. S. Fish and Wildlife Service; and WHEREAS, the U.S. Fish and Wildlife Service requires fee simple title and, therefore, removal from public purpose status; NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: The parcel listed above is approved for transfer by Quit Claim Deed to Olga McCormick facilitating a sale from Olga McCormick to the U. S. Fish and Wildlife Service. Section 2: The sale proceeds will be distributed pursuant to AS 29.45.480 (b). Section 3: The parcel is no longer needed for a public purpose.
