2001-01 Approving Amendment to PERSKODIAK ISLAND BOROUGH RESOLUTION NO. 2001 -01 Introduced by: Manager Jense Requested by: Finance Departmen Drafted by: Borough Cler Introduced: 01/04/2001 Adopted: 01/04/2001 A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AUTHORIZING AN AMENDMENT TO THE BOROUGH'S PARTICIPATION AGREEMENT WITH THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM (PERS) OF ALASKA TO PROVIDE FOR PARTICIPATION OF ELECTED OFFICIALS AND THE PAYMENT OF THE REQUIRED PREMIUMS WHEREAS, the Kodiak Island Borough entered into a Public Employees' Retirement System (PERS) Participation Agreement with the State of Alaska, Department of Administration; and WHEREAS, during the last legislative session, House Bill 335 was signed into law that changed the Public Employees' Retirement System (PERS) statutes effective August 20, 2000; and WHEREAS, this change requires that employers that wish to include elected officials in the PERS must amend their Participation Agreement; and WHEREAS, amending the Participation Agreement to include elected officials would still allow each elected official the option to waive participation in PERS; and WHEREAS, the Kodiak Island Borough wishes to amend the Participation Agreement to allow elected officials receiving compensation to participate in the PERS; NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH that Section 1: Section 3: Pursuant to AS 39.35.550 the governing body of the Kodiak Island Borough hereby requests permission to allow elected officials receiving compensation to be included in the Public Employees' Retirement System of Alaska. Section 2: The Kodiak Island Borough further requests that inclusion of elected officials in the Public Employees' Retirement System of Alaska be effective August 20, 2000. The Kodiak Island Borough manager is authorized and directed to take any and all steps necessary to enroll the elected officials in the Public Employees' Retirement System of Alaska and to initiate a Participation Agreement amendment between the Kodiak Island Borough and the State of Alaska, Department of Administration.
