A JOINT RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
AND THE COUNCIL OF THE CITY OF KODIAK
AGREEING IN PRINCIPAL TO THE TRANSFER OF ASSETS AND LIABILITIES
ASSOCIATED WITH THE RESPONSIBILITIES FOR PROVIDING SERVICES
IN THE EVENT AREAS NORTHERLY OF THE CURRENT CITY OF KODIAK
BOUNDARIES ARE ANNEXED INTO THE CITY OF KODIAK
WHEREAS, residents of the service areas northerly of the City of Kodiak have
circulated a petition for annexation of the area into the City; and
WHEREAS, it is the expressed intent to seek annexation of all of the service district
known as Fire Protection Area No. 1; and
WHEREAS, the Alaska Administrative Code requires that a plan for transfer of
responsibilities and services be prepared by the annexing municipality before a
recommendation for annexation is presented to the Local Boundary Commission; and
WHEREAS, the Borough and City agree that assets acquired and constructed with
public funds for the purpose of discharging responsibilities and delivering services to
the residents of the annexation area, and liabilities against public bodies relating to
such responsibilities and services should properly be transferred simultaneously with
the responsibilities and services for which they are intended; and
WHEREAS, the interests of the public seeking to place the annexation question on the
ballot in the 1998 municipal election are best served by a clear, reasonable, and
expeditions plan for transfer of responsibilities and services if the annexation is
approved; and
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that the Borough agrees to transfer to the City of Kodiak and the City of
Kodiak agrees to accept assets and liabilities associated with the responsibilities that
will be transferred and services that will be provided to the residents of areas northerly
of the current boundaries of the City of Kodiak in the event such areas are annexed
into the City of Kodiak.
