A RESOLUTION CALLING FOR IMMEDIATE STATE ACTION
BY THE STATE OF ALASKA TO PREVENT FEDERAL TAKE -OVER OF
FISH AND GAME MANAGEMENT IN ALASKA
WHEREAS, subsistence is an important part of the lifestyles in the villages on the
Kodiak Island archipelago, with a number of families depending on subsistence for
their food; and
WHEREAS, the commercial and sport fishing and hunting industries represent a
significant component in the Kodiak Island archipelago economy, representing a large
percentage of jobs and payroll within the Kodiak Island Borough; and
WHEREAS, Title VIII of the Alaska National Interest Land Conservation Act (ANILCA)
provides a rural preference for the subsistence harvesting of fish and game resources
and the federal regulation of fish and game on federal land, unless Alaska adopts a
rural subsistence preference consistent with federal law; and
WHEREAS, Article VIII, Section 17 of the Alaska Constitution provides that the "laws
and regulations governing the use or disposal of natural resources shall apply equally
to all persons similarly situated "; and
WHEREAS, past efforts undertaken by the Alaska Legislature to meet the terms of
ANILCA have been declared unconstitutional by the Alaska Supreme Court; and
WHEREAS, Congress has adopted, since the passage of ANILCA, two moratoriums
related to the federal management of fisheries in Alaska, and the current moratorium
is scheduled to expire on October 1, 1997, unless some legislative action is enacted;
and
WHEREAS, the State of Alaska is better situated and qualified to manage and
regulate Alaska's fish and game resources;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that the State of Alaska Congressional delegation, Legislature and
Governor is supported and urged to take immediate and positive action to prevent and
reverse federal take -over of fish and game management in Alaska and returning
effective management to the State.

NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE ASSEMBLY OF THE KODIAK
ISLAND BOROUGH that all Alaskans are encouraged to work together as a unified
group to accomplish its common goal of preventing the federal intervention into
fisheries management and to return all game management to the State of Alaska,
while addressing the concerns expressed by the attached Koniag Region Subsistence
Summit proposal and the concerns of other Alaskans.
