2000-20 Rezoning Lots Island Lake SubdivisionKODIAK ISLAND BOROUGH ORDINANCE NO. 2000 -20 Introduced by: Manager Jensen Requested by: Planning & Zoning Commission Drafted by: Community Development Department Introduced: 12/07/2000 Public Hearing: 12/21/2000 Amended: 12/21/2000 Adopted: 12/21/2000 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOTS 1A-12B, BLOCK 1, ISLAND LAKE SUBDIVISION; AND LOTS 7A, 7B, 7C, AND 8, BLOCK 1, MILLER POINT SUBDIVISION 1 ADDITION FROM R1- SINGLE FAMILY RESIDENTIAL TO R2 -TWO FAMILY RESIDENTIAL (GENERALLY LOCATED ALONG ISLAND LAKE ROAD, ARCTIC TERN STREET, KITTIWAKE STREET, AND PTARMIGAN PASS STREET) WHEREAS, the owner of Lots 5 and 6, Block 1, Island Lake Subdivision have requested that these tracts be rezoned from R1- Single Family to R2 -Two Family Residential; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public hearing on this rezone request at their September 20, 2000 regular meeting; and WHEREAS, upon consideration of the request, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve the rezoning of Lots 1A-12B, Block 1, Island Lake Subdivision; and Lots 7A, 7B, 7C, and 8, Block 1, Miller Point Subdivision 1st Addition. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: LOTS 1A-12B, Block 1, Island Lake Subdivision; and Lots 7A, 7B, 7C, and 8, Block 1, Miller Point Subdivision 1" Addition are hereby rezoned from R1- Single Family Residential to R2 -Two Family Residential. Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission are hereby confirmed as follows: 17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. A rezone from R1 to R2 is needed and justified because the R2 zoning district permits development that: A. Corresponds with the medium density land use designation contained in the KIB Comprehensive Plan; Kodiak Island Borough, Alaska Ordinance No. 2000 -20 Page 1 of 2 ATTEST: B. Will make available to property owners within the rezone area the same option for two - family residential development that is available to nearly all other property owners in subdivisions surrounding Island Lake Subdivision; C. Does not conflict with existing neighborhood character, which is defined by a mix of residential and commercial development; D. Has potential density that can be effectively controlled by the zoning code parking requirements for duplex use on substandard size lots within the rezone area; and E. May serve as an engine of change by providing an impetus to upgrade the area through consolidation of nonconforming lots and replacement of older homes and mobile homes with new duplexes. 17.72.020 B. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. Kodiak Island Borough, Alaska A change of zoning from R1- Single Family Residential to the R2 -Two Family Residential zoning district is necessary because: R2 zoning is consistent with the medium density land use designation for this area contained in the 1968 KIB Comprehensive Plan. Section 4: This rezone shall become effective upon adoption, and the official zoning map shall be updated to reflect this rezoning.
