AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
DETERMINING THE DISPOSITION OF TAX FORECLOSED PROPERTIES FROM
THE 1997 TAX YEAR
WHEREAS, the Kodiak Island Borough has acquired real properties as a result of
the tax foreclosure procedure from the 1997 tax year; and
WHEREAS, Alaska Statutes (AS) 29.45.460 Disposition and sale of foreclosed
property states:
(a) The municipality shall determine by ordinance whether foreclosed
property deeded to the municipality shall be retained for a public purpose. The
ordinance must contain the legal description of the property, the address or a
general description of the property sufficient to provide the public with notice of
its location, and the name of the last record owner of the property as the name
appears on the assessment rolls.
(b) Tax foreclosed property conveyed to a municipality by tax
foreclosure and not required for a public purpose may be sold. Before the sale of
tax foreclosed property held for a public purpose, the municipality, by ordinance,
shall determine that a public need does not exist; and
WHEREAS, The Kodiak Island Borough Planning and Zoning Commission has
reviewed the list of 1997 tax foreclosed properties as required by KIBC
18.10.030, has conducted a public hearing on the disposition of the subject
parcels, and has made a formal recommendation to the Assembly on the parcel's
disposition; and
WHEREAS, the Kodiak Island Borough Manager has reviewed the Commission's
action, as required by KIBC 18.10.030; and
WHEREAS, the Borough Manager has recommended that all of the 1997 tax
foreclosed properties are not required for any public purpose and should be sold
at a future Borough land sale.

NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK
ISLAND BOROUGH THAT:
Section 1: This ordinance is not of a general and permanent nature and shall not
be codified.
Section 2: The following 1997 tax foreclosed properties are not required for any
public purpose and shall be sold at a future Borough land sale:
Tract E -2A, U.S. Survey 3218 (Plat No. 85 -13) - 3338 Mill Bay Road
