1999-07 Ballot Measure - KATS FAILEDAN ORDINAN , E THE OCT IF PAS KODIAK KODIAK ISLAND BOROUGH ORDINANCE NO. 99 -07 Introduced by: Assemblymember Branson Requested by: KATS Advisory Committee Drafted by: CDD Introduced: 08/19/99 Failed to Advance to Public Hearing: 08/19/99 PLACING A BALLOT MEASURE BEFORE THE VOTERS AT ER 5, 1999 REGULAR MUNICIPAL ELECTION THAT, D BY THE VOTERS, WOULD ESTABLISH THE A EA TRANSIT SYSTEM (KATS) SERVICE AREA WHEREAS, the communit has shown support for the continued operation of the Kodiak Area Transit System ATS) by signing a petition to encourage the assembly to initiate a KATS service area . provide a local funding mechanism for KATS; and WHEREAS, Kodiak Island Borough ode (KIBC) 4.05.04 provides that the assembly initiate the establishing of a service : rea by introducing an ordinance effecting the proposed action. WHEREAS, KIBC 4.05.060 provides that a ordinance establishing a service area shall not be effective unless approved by a majo y of the qualified voters voting on the question in the area affected by the ordinance. WHEREAS, KIBC 4.05.050 provides that the a sembly shall consider and make findings on the following issues: 1) the need for s- rvices within the area, and the feasibility of providing them, considering the area's siz population, and the facilities and services already existing therein; 2) the assessed or : stimated value of all taxable property within the area; 3) the characteristics of the area ndicating its cohesiveness as a community; and 4) the area's ability to pay for the pr.. osed service. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF E KODIAK ISLAND BOROUGH THAT: Section 1: Election. An election shall be held within 75 days of the .. option of this ordinance, within the area shown on Exhibit A attached he eto, to place before the registered voters residing within the proposed ser e area the following question: Kodiak Island Borough, Alaska "Shall the Kodiak /s /and Borough exercise transit system ope - tion, maintenance, and asset management powers within the area indic- ed on the attached map?" Ordinance No. 99 -07 Page 1 of 3 Saction 2: Section 3 of this ordinance is of a general and permanent nature and shall become a part of the Kodiak Island Borough Code of Ordinances. The remainder shall not be codified. Section 3: Title 4 of the Kodiak Island Borough Code of Ordinances is hereby mended by adding Section 4.130 Kodiak Area Transit System Service A ea, to read: Kodiak Island Borough, Alaska 4.13 Kodiak Area Transit System Service Area. A. ere is established a service area within the borough designated as the " odiak Area Transit System Service Area" as shown on the correspon ng map in the clerk's office. B. The Ko•'ak Area Transit System Service Area shall provide for operation, main - nance, and asset management services for a public transit system wi • in its boundaries. C. The Kodiak Are Transit System Service Area board shall consist of seven members app.' ted by the Borough Assembly. Section 4. Findings. 1. There is a need for transit se ices within the area as demonstrated by increasing transit system ridership during the i 'tial KATS pilot project. The operation of a transit system in the proposed service area 's feasible, also as demonstrated by the eighteen -month KATS pilot project. The pilot roject has established a ridership base that provides more ridership revenue than s ilar systems; and stable grant funding has provided approximately sixty percent of he transit system's funding. 2. The estimated value of all taxable . roperty in the area is $607,576,608. 3. The service area represents a cohesive com nity base for transit services, based on the feasibility study used as the framework to develop the Kodiak Area Transit System pilot project. A larger geographical area is no feasible to serve because of the dispersed population base. A smaller geographic area ould eliminate the population base that represents many of the primary users of the . ilot project's services. 4. The area has an ability to pay the estimated .2 to .3 mills o tax levy that are thought to be the necessary local contribution to maintain the current -vel of service provided by the pilot project. By comparison, this amount is only about haIf of what Service District 1 resident's pay for road maintenance services. Ordinance No. 99 -07 Page 2 of 3 Sect . n 5. Effective Date. Sections 1, 2, and 4 shall become effective at midnight on the . ay of adoption. Section 3 shall become effective on the first Monday after the election 's certified, if a majority of those qualified voters casting their ballots inside the City o Kodiak and outside the City of Kodiak, each vote in favor of the measure.
