1999-03 Rezoning Lots USS Survey 3099 - Spruce Cape RoadSection 2: Section 3: KODIAK ISLAND BOROUGH ORDINANCE NO. 99 -03 Requested by: Planning Zoning & Commission Drafted by: Community Development Department Introduced: 06/17/99 Public Hearing: 07/01/99 Adopted: 07/01/99 AN ORDINANCE REZONING LOTS 15A 15B, 15C, AND 15D, U.S. SURVEY 3099 FROM R -1 -- SINGLE FAMILY RESIDENTIAL TO R- 2 - -TWO FAMILY RESIDENTIAL (2903, 2911, 2927, and 2933 SPRUCE CAPE ROAD) WHEREAS, the property owner of Lots 15A, 15B, 15C, and 15D, U.S. Survey 3099 requested that the lots in this subdivision be rezoned from R -1 -- Single Family Residential to R- 2 - -Two Family Residential; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public hearing on this request at their May 19, 1999 regular meeting; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve this rezone; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Lots 15A, 15B, 15C, and 15D, U. S. Survey 3099 are hereby rezoned from R -1 -- Single Family Residential to R- 2 - -Two Family Residential. The findings of the Kodiak Island Borough Planning and Zoning Commission are hereby confirmed as follows: KIBC 17.72.020 A. Findings as to the Need and Justification for the Rezone: A rezone from R -1 -- Single Family Residential to R- 2 - -Two Family Residential is needed and justified because the R- 2 - -Two Family Residential zoning district permits development that: A. Is in accordance with the medium /high density residential designation for this area indicated by the Year 2000 Land Use Plan, contained in the Kodiak Island Borough Comprehensive Plan; Kodiak Island Borough, Alaska Ordinance No. 99 -03 Page 1 of 2 ATTEST: Kodiak Island Borough, Alaska B. Will not create any nonconforming land uses in the rezone area; and C. Will not create negative impacts resulting from dramatically increased traffic. KIBC 17.72.020 B. Findings as to the Effect the Rezone will have on the Objectives of the Comprehensive Plan. A change of zoning from R -1 -- Single Family Residential to R- 2 - -Two Family Residential is consistent with the objectives of the Comprehensive Plan which designates this area as medium and high density residential.
