1998-20 Rezoning Portion of Kadiak SubdivisionKODIAK ISLAND BOROUGH ORDINANCE NO. 98 -20 WHEREAS, the owner of these lots has requested this rezone; and Introduced by: Mayor Selby Requested by: Planning & Zoning Commission Drafted by: Community Development Department Introduced: 07/16/98 Public Hearing: 08/06/98 Adopted: 08/06/98 AN ORDINANCE REZONING A PORTION (APPROXIMATELY 3/4 ACRE) OF LOT 5, BLOCK 1, KADIAK SUBDIVISION 1ST ADDITION FROM R -3 MULTI FAMILY RESIDENTIAL TO B- BUSINESS AND A PORTION OF TRACT C -1A WOODLAND ACRES 7TH ADDITION FROM R2 -TWO FAMILY RESIDENTIAL TO B- BUSINESS (3465 TUGIDAK COURT AND 3484 REZANOF DRIVE EAST) WHEREAS, the Planning and Zoning Commission held public hearings on this request on May 20 and June 17, 1998; and WHEREAS, the Planning and Zoning Commission has recommended that the Assembly approve this rezone; and WHEREAS, the Planning and Zoning Commission has adopted findings of fact in support of this recommendation; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of a general and permanent nature and shall not become a part of the Kodiak Island Borough Code of Ordinances. Section 2: The portion of Lot 5, Block 1, Kadiak Subdivision 1st Addition proposed for inclusion into Lots 4A and 4B (according to the preliminary plat for the Kodiak Island Borough Planning and Zoning Commission Subdivision Case No. S98 -008) is hereby rezoned from R3 -Multi Family Residential to B- Business. Section 3: The portion of Tract C -1 A, Woodland Acres 7th Addition currently zoned R -2 Two Family Residential is hereby rezoned to B- Business. Section 4: This rezone shall become effective upon recording of the final plat for the Kodiak Island Borough Planning and Zoning Commission Subdivision Case No. S98 -008. Kodiak Island Borough, Alaska Ordinance No. 98 -20 Page 1 of 2 Section 5: The official zoning map shall be updated to reflect this rezone. Section 6: The findings of fact of the Kodiak Island Borough Planning and Zoning Commission in recommending the approval of this rezone are hereby confirmed as follows: 17.72.020A. Findings as to the Need and Justification for a Change or Amendment. A rezone from R2 -Two Family Residential and R3 -Multi Family Residential to B- Business is needed and justified because the B- Business zoning district permits development that: A. Is consistent with recent development patterns in the vicinity that tend to support the concept of commercial zoning. B. Since newly created business zoning will be attached to existing B- Business zoned lots with no new business lots or uses created, there will be minimal, if any, additional traffic or access impacts resulting from the rezone. C. No nonconforming uses will be created by the rezone, and established commercial uses on the properties appear to coexist compatibly with neighboring residential uses. 17.72.020B. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. A change of zoning from R2 -Two Family Residential and R3 -Multi Family Residential to B- Business commercial zoning is not strictly in conformity with the mobile home park designation for this area in the 1968 Comprehensive Plan. However, as previously noted in an earlier rezone to B- Business (Case No. 88 -036), commercial zoning shares fairly intensive development and density characteristics with mobile home park development.
