AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
AMENDING KODIAK ISLAND BOROUGH CODE OF ORDINANCES
TITLE 13 UTILITIES TO PROVIDE FOR THE CHANGE
TO A MANAGER PLAN OF GOVERNMENT

WHEREAS, the Kodiak Island Borough will revert to a manager plan of government
on October 19, 1998; and
WHEREAS, the governing body shall enact provisions for the reorganization of the
municipal executive and administrative functions;
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is of a general and permanent nature and shall become a
part of the Kodiak Island Borough Code of Ordinances.
Section 2: Title 13 Utilities of the Kodiak Island Borough Code of Ordinances is
amended to read as follows:
TITLE 13
UTILITIES
13.01.199 Indirect costs. Indirect costs will be allocated to the various capital improvements
projects based on a reasonable formula developed by the borough engineer. The formula as
developed will be approved by the [er]manager and implemented by the director of finance.
Indirect costs so allocated will be posted to the accounting system of the project not less frequently
than quarterly (monthly preferred).

A. Projects under construction. Indirect cost allocation for projects under construction
will be by a reconcilable formula developed by the borough engineer, approved by the
[mayer]mager and implemented by the director of finance.

B. Completed projects. Completed projects are closed out from the capital improvements
fund and are capitalized into the respective utility fund. Thereafter the services provided by the
general fund water and sewer type funds will be accomplished on a reimbursable basis. This will
be through a reasonable allocation process developed and implemented by the director of finance
after approval by the [mayer]man ger.
13.02.101 Turn on, turn off authority. No person except as authorized by the [mayer]manager
or his designee shall turn on or off any corporation stop, curb stop or valve, or in any manner
disturb the borough water system. Where repairs to service from curb stop to building are
necessary, persons may turn off curb stop for only such time as is required to make such repairs.
13.01.060 Delinquency and penalty. All accounts that are unpaid after the fifteenth of the month
will be considered delinquent. All delinquent accounts will be listed on a "shut -off" register and
a copy of such register will be made available to the [mayer]manager. Accounts on the "shut -off"
register may be disconnected from service.
13.04.010 Administration.
B. The [mayer]manager shall review and act upon appeals from decisions of the borough

13.04.030 Appeals from the borough engineer.
A. A decision of the borough engineer, or his authorized representative, under this title
is final unless appealed to the [mayer]manager: within ten (10) working days of the mailing of
notice of the decision. An appeal is commenced by filing with the [mayer=]manager a written
notice of appeal specifically stating the reason for the appeal and the relief sought.
13.04.040 Appeals -- Hearing and decision.
A. The [mayer]manager shall review the record and hear evidence and arguments
presented by persons affected in the appeal.
B. The [mayer]manager shall either affirm or reverse the decision of the borough engineer
in whole or in part.
C. The [mayor's]manager's decision on an appeal shall be mailed to the parties to the
appeal within ten (10) days of the decision and shall state the reasons for the decision in a
reasonably specific manner so as to provide a clear and precise understanding of the decision.
Section 3: Effective date. Sections 1 and 2 of this ordinance shall become effective
to be in full force and effect at midnight on October 18, 1998.
