1998-05 Amending Title 2 Admin and Personnel - KATS CommitteeKODIAK ISLAND BOROUGH ORDINANCE NO. 98 -05 Introduced by: Mayor Selby Requested by: Assembly Drafted by: Community Development Department Introduced: 04/07/98 Public Hearing: 04/16/98 Adopted: 04/16/98 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING THE KODIAK ISLAND BOROUGH CODE OF ORDINANCES TITLE 2 ADMINISTRATION AND PERSONNEL TO ADD CHAPTER 2.51 KODIAK AREA TRANSIT SYSTEM ADVISORY COMMITTEE WHEREAS, the Kodiak Island Borough assembly enacted Resolution No. 97 -02 authorizing the mayor to submit grant applications and to prepare a transit management plan for future action by the assembly; and WHEREAS, the Kodiak Island Borough and Senior Citizens of Kodiak, Inc. staff, with the assistance and cooperation of other non - profit organizations in the community, submitted grant applications for funding in the spring of 1997; and WHEREAS, the Kodiak Island Borough and the Senior Citizens of Kodiak, Inc. were awarded grant funds to establish the Kodiak Area Transit System (KATS); and WHEREAS, the Kodiak Island Borough assembly enacted Ordinance No. 97 -10A, amending Ordinance No. 97 -10 Fiscal Year 1998 Budget, to accept funds and create financial accounts for the KATS; and WHEREAS, the Kodiak Island Borough assembly authorized the solicitation of proposals for the management and operation of the KATS and, upon review, authorized the mayor to enter into a contract with Laidlaw Transit, Inc. for this service; and WHEREAS, the Kodiak Island Borough assembly established the Kodiak Area Transit System Advisory Committee to help guide the implementation of the KATS and requested that the committee recommend an organizational model for the committee, including recommended powers and duties; and WHEREAS, the committee has recommended that the assembly adopt an ordinance creating the Kodiak Area Transit System Advisory Committee, as a permanent Kodiak Island Borough advisory committee. Kodiak Island Borough, Alaska Ordinance No. 98 -05 Page 1 3 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is of a general and permanent nature and shall become a part of the Kodiak Island Borough Code of Ordinances. Section 2: Title 2 of the Kodiak Island Borough Code of Ordinances is amended by adding Chapter 2.51 Kodiak Area Transit System Advisory Committee as follows: Sections: KODIAK AREA TRANSIT SYSTEM ADVISORY COMMITTEE 2.51.010 Created — Membership. 2.51.020 Term — Compensation. 2.51.030 Powers and duties. 2.51.040 Administrative assistance. Chapter 2.51 2.51.010 Created — Membership. There is created a Kodiak Area Transit System Advisory Committee that shall consist of nine (9) borough residents, of which seven (7) are appointed in accordance with section 2.39.030 of this title. In addition, one (1) assembly representative and one (1) city of Kodiak representative shall also be full voting members of the committee. The assembly shall select the assembly representative and the Kodiak city council shall select the city of Kodiak representative. The community development department director and a United States Coast Guard representative shall serve as non - voting ex- officio members of the committee and the mayor may, with the concurrence of the assembly, appoint additional non - voting ex- officio members. The board shall designate its chairperson. 2.51.020 Term — Compensation. A. The members shall serve for three (3) years; however, of the members first appointed, three (3) shall be appointed for three (3) years, two (2) for two (2) years, and two (2) for one (1) year. Appointments to fill vacancies shall be for the unexpired term only. B. Members of the committee shall serve without compensation. 2.51.030 Powers and duties. The committee shall function as the liaison between the borough and the transit system contractor and shall be responsive to the concerns of the community regarding the operation of the transit system. Specifically the duties and responsibilities of the committee include the following: A. Review any changes in transit system policies. The transit system contractor Kodiak Island Borough, Alaska Ordinance No. 98 -05 Page 2 of 3 or the committee may suggest policies but all require review by the committee. A policy is defined as a definite course of action pursued by service contractor. B. Review and approve any new transit system services. C. Review the operating and capital budgets prepared for the transit system. D. Review and approve the rate and charge structures of the transit system. E. Review and comment concerning the quality of service rendered by the transit system contractor. F. Review reports prepared by the transit system contractor. G. Cooperate with the transit system contractor to ensure that the requirements of any federal and /or state law or statute is met by the transit system. H. Conduct long -range planning for the transit system, including coordination with non - profit community groups to plan for their client transportation needs. I. Review transit system contracts, as necessary, and make recommendations to the assembly. J. Assist the transit system contractor in determining and deciding all matters of policy relating to the public relations of the transit system and the relationship of the transit system to the community and the surrounding area that it serves. 2.51.040 Administrative assistance. The mayor, or designee, shall: A. Furnish the committee with copies of all requested documents and other information necessary or reasonably related to committee functions; B. Provide the committee with such supplies, meeting space, and secretarial assistance as the mayor deems reasonably required; C. Refer to the committee, for their discussion, all non- emergency matters within the scope of its powers and duties prior to presenting those matters to the assembly for action; and D. Transmit all recommendations and other communications from the committee to the assembly.
