1997-26 Rezoning Portions - Aleutian Homes SubdivisionKODIAK ISLAND BOROUGH ORDINANCE NO. 97 -26 Introduced by: Mayor Selby Requested by: Planning & Zoning Commission Drafted by: Community Development Department Introduced: 12/04/97 Public Hearing: 12/18/97 Adopted: 12/18/97 AN ORDINANCE REZONING LOT 18, BLOCK 8; LOT 6 BLOCK 11; AND LOTS 35, 36A AND 59, BLOCK 12, ALEUTIAN HOMES SUBDIVISION FROM B- BUSINESS TO R1- SINGLE FAMILY RESIDENTIAL (521, 611, 613, 1017, and 1111 Mill Bay Road) WHEREAS, these parcels were rezoned from R1- Single family residential to B- Business in 1988, in anticipation of commercial development along Mill Bay Road; and WHEREAS, these B- Business zoned parcels contain non - conforming residential structures; and WHEREAS, the 1968 Comprehensive Plan identifies this area as R1- Single Family Residential; and WHEREAS, the owners of these parcels have requested that their property be rezoned back to R1- Single Family Residential; and WHEREAS, The Planning and Zoning Commission held a public hearing on this request on November 19, 1997 and recommends that the Assembly approve this rezone; and, WHEREAS, The Planning and Zoning Commission has adopted findings of fact in support of this recommendation; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not become part of the Kodiak Island Borough Code of Ordinances. Section 2: Lot 18, Block 8; Lot 6 Block 11; and Lots 35, 36A and 59, Block 12, Aleutian Homes Subdivision are hereby rezoned from B- Business to R1- Single Family Residential. Section 3: The official zoning map shall be updated to reflect this rezone. Section 4: The findings of fact of the Kodiak Island Borough Planning and Zoning Commission in recommending the approval of this rezone are hereby confirmed as follows: Kodiak Island Borough, Alaska Ordinance No. 97 -26 Page 1 of 2 17.72.020 A. Findings as to the Need and Justification for a Change or Amendment. A rezone from B- Business to R1 Single- family Residential is needed and justified because the R1 zoning district permits residential development that: A. is consistent with the Kodiak Island Borough Comprehensive Plan; B. is consistent with the existing use of these five lots as single - family residences, thereby eliminating five nonconforming uses; C. is better suited to road design capacity and safety, having less traffic demands than commercial uses; D. is better suited to the size and location of the lots to meet parking, access and circulation requirements; and E. will advance and facilitate residential use of existing homes by affording home owners structural expansion options not available to nonconforming residential uses on small B- Business lots. 17.72.020 B. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. A change of zoning from the B- Business to R1 Single- family Residential zoning district is necessary to be consistent with the medium density residential designation of the Comprehensive Plan, thereby eliminating five nonconforming uses and potentially reducing traffic problems along one of the busiest arterial in Kodiak.
