AN ORDINANCE REZONING TRACT D, U.S. SURVEY 5509
FROM W- WATERSHED TO PL- PUBLIC USE LANDS
(GENERALLY LOCATED WITHIN THE CITY OF PORT LIONS)
WHEREAS, the owner of Tract D, U.S. Survey 5509 has requested that this parcel be
rezoned; and
WHEREAS, rezoning this lot to PL- Public Use Lands is consistent with the 1997 Revised
Port Lions Comprehensive Development Plan; and
WHEREAS, the Planning and Zoning Commission held a public hearing on this request
on November 19, 1997 and recommends that the Assembly approve this
rezone; and
WHEREAS, the Planning and Zoning Commission has adopted findings of fact in support
of this recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is not of general application and shall not become part of the
Kodiak Island Borough Code of Ordinances.
Section 2: Tract D, U.S. Survey 5509 is hereby rezoned from W- Watershed to PL-
Public Use Lands.
Section 3: The official zoning map shall be updated to reflect this rezone.
Section 4: The findings of fact of the Kodiak Island Borough Planning and Zoning
Commission in recommending the approval of this rezone are hereby
confirmed as follows:

17.72.020 A. Findings as to the Need and Justification for a Change or Amendment.
A rezone from W- Watershed to PL- Public Use Lands is needed and justified because the
PL- Public Use Lands zoning district permits development that:
A. is consistent with the Public Land designation of this parcel in the 1997 Revised
Port Lions Comprehensive Development Plan;
B. will facilitate dispensation of needed social and community services, including the
Village Spirit Program for teens, the Indian Tribal Welfare Program, Title 6 Food
program for seniors, a tribal cultural center, offices and perhaps a clinic, through the
Tribal Council community building /cultural center, which is a permitted use in the
proposed PL- Public Use Lands; and
C. will rezone a tract that has good accessibility for both vehicular and pedestrian
traffic near the Port Lions' population core and provides a reasonable site adjacent
to established right -of -ways for the development proposed.
17.72.020 B. Findings as to the Effect a Change or Amendment would have on the
Objectives of the Comprehensive Plan.
A change of zoning from W- Watershed to PL- Public Use Lands zoning district is necessary
in order to make the zoning consistent with the 1997 Revised Port Lions Comprehensive
Development Plan, to allow construction of the Tribal Council community center /cultural
building as a permitted use, and to facilitate dispensation of needed social and community
services under a single roof.
