A ORDINANCE PLACING THE QUESTION OF EXPANDING THE FIRE PROTECTION
AREA NO. 1 (BAYSIDE VOLUNTEER FIRE DEPARTMENT) BOUNDARIES ON THE
OCTOBER 7, 1997 BALLOT
WHEREAS, the Fire Protection Area No. 1 Board voted unanimously to place the
question on the ballot to expand the boundaries to include the area from its present
boundary west to Pillar Creek and north to Monashka Bay Beach; and
WHEREAS, the Fire Protection Area No. 1 provides emergency service response to
the proposed area although there is no tax revenue received; and
WHEREAS, Kodiak Island Borough Code 4.05.040 provides that the assembly shall
initiate any action to alter a service area by introducing an ordinance effecting the
proposed action; and
WHEREAS, Kodiak Island Borough Code 4.05.060 provides that an ordinance altering
a service area shall not be effective unless approved by a majority of the qualified
voters voting on the question in each area affected by the ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: The Fire Protection Area No. 1 boundaries will be altered to the
following described area:
"Commencing at corner No. 6, U.S. Survey 2873, as shown on a plat of
said survey dated October 17, 1950, thence continuing seaward S 36°
44' 13" E, to a point on said line a distance of 299.59 feet, which is the
TRUE POINT OF BEGINNING, thence along the following courses:
(1) N 65° 55' 12" E a distance of 2447.12 feet; thence
(2) N 47° 39' 03" E a distance of 2488.56 feet; thence
(3) N 59° 10' 37" E a distance of 1322.06 feet; thence
(4) N 36° 45' 25" E a distance of 7633.24 feet; thence
(5) N 18° 27' 31" W a distance of 2061.02 feet; thence
(6) N 53° 34' 06" W a distance of 7174.83 feet; thence
(7) S 59° 01' 38" W a distance of 11,299.08 feet; thence
(8) S 64° 08" 05" W a distance of 3,728.76 feet; thence

(16) S 01° 21' 10" E a distance of 5420.98 feet to a point of
intersection with the northwest boundary of U.S. Survey 3945; thence
northeast following the duly established corporate boundaries of the city
of Kodiak to the POINT OF BEGINNING.
CONTAINING 5,006 ACRES MORE OR LESS."
Section 2: An election shall be held on Tuesday, October 7, 1997, between the
hours of 7:00 a.m. and 8:00 p.m. of said date and there shall be
submitted to the duly qualified registered voters of the Fire Protection
Area No. 1 the following question:
"Shall the boundaries of the Fire Protection Area No. 1 be altered
to expand the existing service area to the end of Monashka Bay Road
and to effect the boundaries as legally described:
"Commencing at corner No. 6, U.S. Survey 2873, as shown on a plat of said survey dated October 17,
1950, thence continuing seaward S 36° 44' 13" E, to a point on said line a distance of 299.59 feet, which
is the TRUE PO /NT OF BEGINNING, thence along the following courses:
(1) N 65° 55' 12" E a distance of 2447.12 feet; thence

Section 3: A person who is qualified to vote in the Fire Protection Area No. 1 or the
area described in this ordinance may vote in the election.
Section 4: The polling place for this election will be in the Mission precinct at East
Elementary School.
Section 5: Notice of the election shall be published not less than thirty days prior
to the election in the form and manner provided by AS 29.38.050 and
Title 7 of the Kodiak Island Borough Code of Ordinances.
Section 6: Upon passage of the proposition to alter the boundaries of the Fire
Protection Area No. 1 by the qualified voters of that area and upon
certification of said election, this ordinance shall become effective.
