1997-03 Creating Airport Fire Protection Service AreaKODIAK ISLAND BOROUGH ORDINANCE NO. 97 -03 Introduced by: Mayor Selby Requested by: Mayor Selby Drafted by: Mayor Selby Introduced: 03/06/97 Public Hearing: 03/20/97 Adopted: 03/20/97 AN ORDINANCE CREATING A SERVICE AREA TO BE KNOWN AS KODIAK ISLAND BOROUGH AIRPORT FIRE PROTECTION DISTRICT FOR THE PURPOSE OF PROVIDING FIRE PROTECTION WITHIN THE SERVICE AREA WHEREAS, Kodiak Island Borough Code of Ordinances 4.05.010 and 4.05.040 and 4.05.050 empowers the Borough to create service areas to provide special services; and WHEREAS, the Kodiak Island Borough has received requests from property and business owners in the area adjacent to the State of Alaska airport requesting the formation of a fire protection district; and WHEREAS, the need for fire protection service in this area of heavily used public facilities of airport terminals, hotels and storage facilities is obvious; and WHEREAS, the assessed value of property in this area is $5,975,800; and WHEREAS, this is a cohesive business area which is all airport related business; and WHEREAS, the area's assessed value is adequate to fund a contract for fire service with an existing fire service until a unified fire service is developed; and WHEREAS, there are three fire service areas adjacent to this area that could contract to deliver fire protection service to this relatively small area; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is of a general and permanent nature and shall become a part of the Kodiak Island Borough Code of Ordinances. Section 2: A service area to be known as Kodiak Island Borough Airport Fire Protection District be and the same is hereby established to provide fire protection for the area lying and being within the boundaries of the Kodiak Island Borough adjacent to the State of Alaska airport described as follows: Situated at the State Airport on the U.S. Coast Guard Integrated Support Command, Kodiak, Alaska, and includes lands described in a 6 sheet unrecorded plat surveyed by the State of Alaska, Department of Kodiak Island Borough, Alaska Ordinance No. 97 -03 Page 1 of 3 1. Thence S 50° 30' 04" E, a distance of 289.20' to the south corner of Lot 2B, Block 2000; 2. Thence S 50° 30' 04" E, a distance of 203.39' to a point on the south right of way of the Chiniak Road (Rezanof Drive East); 3. Thence south and west along the southern right of way of the Chiniak Road (Rezanof Drive East) until it intersects with the west boundary line of Lot 2, Block 1600, a distance of 1422 4. Thence S 2° 0' 0" W, a distance of 185' along the west boundary line of Lot 2, Block 1600, to the southwest corner of Lot 2; 5. Thence S 88° 0' 0" E, a distance of 313' to the southeast corner of Lot 1, Block 1600; 6. Thence N 65 ° 26' 06" E, a distance of 111.80 to the southwest corner of lot 1A, Block 1200; 7. Thence S 88° 0' 0" E, a distance of 618. 14' along the south lot lines of Lots 1A, and 2, and 3B, Block 1200; 8. Thence N 56° 32' 36" E, a distance or 446. 17' to the southeast corner of Lot 4A, Block 1300; 9. Thence N 27 ° 0' 0" E, a distance of 1485.15' to a point on the northeastern boundary line titled the State Airport Boundary as described on sheet 3 of 6; 10. Thence N 64° 23' 55" W, a distance of 1193.50' to the north corner of Lot 1, Block 2000 which is common with the southeast right of way of Tom Stiles Road; 11. Thence in a southwest direction along said right of way, a distance of 391.76' to the north corner of Lot 6, Block 2000; 12. Thence continuing in a southwesterly direction along said right of way, a distance of 383.51' to the west corner of Lot 2B, Lot 2000 to the True Point of Beginning and containing 58.6 acres. Section 3: Servires• Kodiak Island Borough Airport Fire Protection District is hereby established to provide fire protection including administration and collection costs of the same for the area within its boundaries. Section 4• Management: Kodiak Island Borough Airport Fire Protection District shall be managed and operated by the Kodiak Island Borough in the same manner as other Borough functions. Kodiak Island Borough, Alaska Transportations and Public Facilities, Division of Airport Leasing and titled "Kodiak Airport - Land Occupancy" dated June 24, 1981 and being more fully described: Commencing at the west corner of Lot 2B, Block 2000 located on sheet 3 of 6, and being the True Point of Beginning for the land herein described; Ordinance No. 97 -03 Page 2 of 3 Section 5: The Casts. The cost of providing fire protection including administrative costs shall be borne by the property owners of both real and personal property having property within the boundaries of said district and the assembly is hereby authorized to levy taxes against all real and personal property Tying and being within the boundaries of said district to finance the fire protection service in said area, said taxes to be collected in the same manner and at the same time as other real and personal property taxes due in the district and the mill rate for said service to be determined and set for all other purposes in the borough. Section 6: Board. Title 4 is amended by adding a new chapter 4.120 Airport Fire Protection District, to read: 4.190.020 Board The Airport Fire Protection District Advisory Board to consist of five members and shall be appointed by the assembly.
