1997-02 Amending Personnel Rules and RegulationsAN ORDINANCE AMENDING THE PERSONNEL RULES AND REGULATIONS, 1994 EDITION, RELATING TO SHIFT DIFFERENTIAL, EMPLOYEE TRANSFERS, DEMOTION, DISMISSAL NOTICE AND SEVERANCE PAY, HOURS OF WORK, REST PERIODS, OVERTIME, FLEXIBLE SCHEDULING OF WORK HOURS, BEREAVEMENT LEAVE, SICK LEAVE BANK, PERSONNEL RECORDS, AND SALARY SCHEDULE LANGUAGE WHEREAS, the Kodiak Island Borough Assembly, in keeping with the personnel policy, recognizes that personnel rules and regulations must be amended from time to time in order to provide for necessary updated information and clarification; and WHEREAS, the Kodiak Island Borough and its employees are committed to the principle of equal employment opportunity in all employment practices; and WHEREAS, the Kodiak Island Borough Code of Personnel Rules and Regulations was completely revised in September 1994; and WHEREAS, some changes to the personnel policy were subsequently negotiated in the union negotiation process; and WHEREAS, the Personnel Advisory Board reviewed and recommended the Kodiak Island Borough Code of Personnel Rules and Regulations, 1994 Edition, be amended; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is of a general and permanent nature and shall become a part of the Kodiak Island Borough Personnel Rules and Regulations. Section 2: Title 2, Chapter 2.12 is amended by making the following changes in the Personnel Rules and Regulations, 1994 Edition, identified in Section 2.12.010. A. Amend Section 417 as follows: 417 DFMOTION An employee may be demoted for any of the following reasons: A. Inability to perform duties adequately. B. Layoff because of lack of work or funds. When employees are laid off, available position for which they are qualified. C. Personal reasons. Normal working hours will be from 8:00 a.m. to 5:00 p.m. and will include one km hour for lunch. The standard work week shall consist of the period from Ordinance No. 97-02 Page 3 of 8 Sunday to Saturday (i.e.±' „'tii' >tt'#€ to the following midnight Saturday). The standard work day shall consist of the period from [midnight] ZOUN to midnight. Different schedules to meet department operating needs shall be established and altered by department heads with approval of the Borough mayor. Temporary shifting of employees' working hours to meet routine needs shall be done as necessary and approved by the department head. F. Amend Section 603 as follows: 603 RFST PERIODS A fifteen (15) minute rest break shall be allowed mid - morning and mid- afternoon. Such breaks must be staggered to keep all offices adequately staffed to deal with the public at all times. Break schedules must be approved by the appropriate supervisor. G. Amend Section 606 as follows: ROR OVERTIMF hours in a work day. Kodiak Island Borough, Alaska Overtime shall be scheduled as fairly and equally as practicable among employees, based first on qualifications to perform work and secondly on seniority. All overtime must be authorized by the applicable department head prior to its performance. When an employee is assigned to eight (8) hour work days, all authorized overtime shall be compensated at one and one -half ([1 :135) times the employee's applicable rate of pay for all time worked in excess of eight (8) When an employee is assigned to ten (10) hour work days, all authorized overtime shall be compensated at one and one -half ([1 %2] :1::;x:5) times the employee's applicable rate of pay for all time worked in excess of ten (10) hours in a work day. Immediate family is defined as spouse, siblings, son, daughter, parents, stepparents, step- siblings, father-in-law, mother-in-law, brother-in-law, sister-in-law, son-in-law, daughter-in-law, grandparents and grandchildren. Amend Section 1101 as follows: 1101 PFRSONNEI RFCORDS The mayor shall provide and maintain central files for records of the personal and work history of each employee in the Borough service. No personnel files shall be maintained elsewhere in the Borough either by the mayor or department heads. Employees shall have access to their own confidential personnel file. Access to the personnel files by other than the mayor, the employee's immediate supervisor and department head, the personnel and administrative assistant and the head of a Borough department into which the employee has applied for promotion or transfer shall not be allowed without prior approval of the mayor. Other persons shall be permitted access to personnel files only by court order or by the written consent of the employee and upon written approval of the Borough mayor. titoi'a)) is Kodiak Island Borough, Alaska Salary Schedule, Appendix A ua Section 3: Salary Schedule, Appendix A is amended by making the following changes in the Personnel Rules and Regulations, 1994 Edition: Effective July 1, 1997, the Kodiak Island Borough shall pay a seven hundred sixty -eight dollar ($768) bonus to each employee and the Salary Schedule in Appendix A shall remain unchanged. Ordinance No. 97 -02 Page 7 of 8 ATTEST: Effective July 1, 1998, the Kodiak Island Borough shall adjust the Salary Schedule in Appendix A by an increase of one and one -half percent (1.5 %) at Salary Step 7A with all other steps remaining at two and one -half percent (2.5 %) increments. Effective July 1, 1999, the Kodiak Island Borough shall adjust the Salary Schedule in Appendix A by an increase of two percent (2.0 %) at Salary Step 7A with all other steps remaining at two and one -half percent (2.5 %) increments.
