the City of Kodiak has requested that Lot 28, U.S. Survey 3098, be
rezoned from PL-- Public Use Lands to B -- Business in order to allow
continued development of the property for its historical use; and
the Kodiak Island Borough Planning and Zoning Commission held a public
hearing on this rezoning; and
the Kodiak Island Borough Planning and Zoning Commission has
recommended that the Kodiak Island Borough Assembly approve this
rezoning.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
This ordinance is not of general application and shall not be codified.
Lot 28, U.S. Survey 3098 is hereby rezoned from PL-- Public Use Lands
to B -- Business.
The findings of the Kodiak Island Borough Planning and Zoning
Commission are hereby confirmed as follows:
Findings as to the Need and Justification for a Change or Amendment.
A rezone of Lot 28, U.S. Survey 3098 from PL-- Public Use Land to
B -- Business is needed and justified because the rezone will:
A. Allow for the existing and continued variety of intensive business
land uses, envisioned by the adopted plan for this area.

ATTEST:
B. Rezone the subject lot which is suitable and appropriate for the
type of development permitted in the B-- Business Zoning District.
C. Provide zoning that is consistent with both the existing land use
on the lot and the adopted plan for the area.
2. Findings as to the Effect a Change or Amendment would have on the
Objectives of the Comprehensive Plan.
A change of zoning of Lot 28, U.S. Survey 3098 from PL-- Public Use
Land to B -- Business is consistent with the intent of the Lakeside
Subdivision, Safeway Sub -area Land Use Plan. The plan specifically
identifies this lot for general business use, and defines this land use
category as one which permits a wide variety of intensive business land
uses. The requested rezone will bring not only the zoning, but the
current land use of the lot into compliance with the adopted plan for the
area.
