AN ORDINANCE ESTABLISHING CHINIAK SERVICE DISTRICT
TO PROVIDE MAINTENANCE AND SERVICES FOR THE
CHINIAK TSUNAMI SHELTER -- COMMUNITY CENTER -- LIBRARY BUILDING
WHEREAS, Kodiak Island Borough Code 4.05.040 provides for the assembly, by
ordinance, to establish a service area; and
WHEREAS, the assembly shall consider the need for services within the area and the
feasibility of providing services considering the area's size, population,
and the facilities and services already existing; the assessed or estimated
value of all taxable property within the area; the characteristics of the
area indicating its cohesiveness as a community; and the area's ability
to pay for the proposed service; and
WHEREAS, the property owners of the area circulated a petition requesting the
formation of a new service area;
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: Classifi - a +ir,r, Section 3 of this ordinance is of a general and permanent
nature and shall become a part of the Code of Ordinances of the Kodiak
Island Borough. The remainder shall not be codified.
Section 2: Election. An election shall be held on October 4, 1994, within the area
shown on Exhibit A attached hereto, to place before the registered
voters residing within said proposed service area the following question:
"Shall the Kodiak Island Borough exercise the powers necessary to

attached map ?"
The map attached to this ordinance (Exhibit A) shall accompany the
ballot.

Section 3: Title 4 of the Kodiak Island Borough Code of Ordinances is amended by
adding Chapter 4.120 as follows:
Chapter 4.120
CHINIAK SERVICE DISTRICT
Section:
4.120.010 Chiniak service district
4.120.010 Chiniak service district.
A. There is established a service area within the borough designated the
" Chiniak Service District" as shown on the corresponding map in the office of the
borough clerk.
B. The Chiniak Service District shall provide maintenance and services
for the Chiniak Tsunami Shelter -- Community Center -- Library Building within its
boundaries.
C. The Chiniak Service District Board of Supervisors shall consist of five
members elected by the qualified voters within the service area at a regular election.
Section 4: Effective date Sections 1 and 2 shall become effective at midnight on
the day of the adoption of this ordinance. Section 3 shall become
effective on the first day of the calendar year (January 1, 1995)
following the above - mentioned election if a majority of those qualified
voters casting their ballots vote in favor of the issue.
