WHEREAS, a petition to alter e boundary of Service District No. 1 was received
and reviewed as su 'cient by the borough clerk; and
WHEREAS, the area to be detache r rom the service area receives no water, sewer,
or road services; and
WHEREAS, the area affected by the alt ing of the service area is the area thereby
detached from the service ar :; and
WHEREAS, Kodiak Island Borough Code 4.•5.060 provides that an ordinance
altering a service area shall not •e effective unless approved by a
majority of the qualified voters yr ing on the question in the area
affected by the ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE ASSE : LY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: The Service District No. 1 area will be altered . y the detachment of the
following described area:
"A portion of the Miller Point Alaska Subdivision, p: Plat No. 67 -3 in the
Kodiak Recording District, Kodiak, Alaska, bein more specifically
described as follows:
Lots 2 and 3 Block 4; Lots 3, 4A -1, 4A-2, 48 and 4C (p _ Plat N
4) Block 3; and Kraft Way as bounded on the southerly sl a by an arc
line lying fifty feet northerly of and parallel to the centerli of Island
Lake Drive.

Sectio 2: An election shall be held on Tuesday, October 4, 1994, between the
hours of 7:00 a.m. and 8:00 p.m. of said date and there shall be
submitted to the duly qualified registered voters of the area to be
etached from Service District No. 1 the following question:

"A ports n of the Miller Point Alaska Subdivision, per Plat No. 67 -3 in the
Kodiak - cording District, Kodiak, Alaska, being more specifically
described follows:
Lots 2 and 3 = • ck 4; Lots 3, 4A -1, 4A -2, 4B, and 4C (per Plat No. 82-
4) Block 3; and raft Way as bounded on the southerly side by an arc
line lying fifty fee northerly of and parallel to the centerline of Island
Lake Drive.

Section 3: A person who is qualified to vote in the Service District No. 1 area
described in this ordinance may vote 'n the election.
Section 4: The polling place for this election will be ' the Mission Road precinct at
the East Elementary School.
Section 5: Notice of the election shall be published not s than thirty days prior
to the election in the form and manner provide by AS 29.38.050 and
Title 7 of the Kodiak Island Borough Code of Or ances.
Section 6: Upon passage of the proposition to alter the bounda of Service District
No. 1 by the qualified voters of that area and upon ce -' ification of said
election, this ordinance shall become effective January ' 1995.
