ORDINANCE NO. 94-11
AN ORDINANCE AMENDING KODIAK ISLAND BOROUGH CODE OF ORDINANCES
CHAPTER 8.10 ffalaliziwgm TO PROVIDE THAT THE CITY OF KODIAK
MAY ISSUE REVENUE BONDS TO FINANCE A HEALTH, EDUCATION AND
SOCIAL SERVICES CENTER TO BE OWNED AND OPERATED BY THE
KODIAK AREA NATIVE ASSOCIATION
the Kodiak Island Borough (the "Borough ") has assumed areawide health
powers pursuant to a special election held for that purpose; and
the Borough adopted Kodiak Island Borough Code of Ordinances Chapter
8.10 to provide for the
areawide exercise of health powers; and
the City of Kodiak (the "City ") desires to issue revenue bonds (the
"Bonds ") on behalf of Kodiak Area Native Association, Inc. (the
"Association ") to finance the construction of a new health, education
and social services center to be owned and operated by the Association;
and
WHEREAS, Alaska Statute 29 .35.250(b) provides that upon adoption of a borough
ordinance to provide for areawide exercise of a power, no city within the
borough may exercise the power unless a borough ordinance provides
otherwise; and
WHEREAS, it is in the best interest of the Borough and its residents that the Kodiak
Borough Code of Ordinances Chapter 8.10 be amended to provide that
the City may issue the Bonds;
NOW, THEREFORE, BE IT O RDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is of a general and permanent nature and shall become a
part of the Kodiak Island Borough Code of Ordinances.

Section 2: Chapter 8.10 of the Kodiak Island Borough Code of Ordinances is
amended by adding a new Section 8.10.030 to read:
Section 8.10.030 City of Kodiak revenue bonds. Notwithstanding the exercise of
areawide health powers by the borough as provided in sections 8.10.010 and
8.10.020, the City of Kodiak may issue revenue bonds on behalf of the Kodiak Area
Native Association, Inc. to finance the construction of a health, education and social
services center to be owned and operated by Kodiak Area Native Association, Inc.
