AN ORDINANCE REGARDING THE EXXON VALDEZ OIL SPILL,
AMENDING ORDINANCE 89 -15 -0 FOR CLARIFICATION
WHEREAS, Ordinance 89 -15 -0 - "An Ordinance Of The Kodiak
Island Borough Assembly Establishing An Emergency Fund To
Accumulate Costs Of The Oil Spill Disaster And Appropriating 011
Spill Cleanup Account Funds Received From The State Of Alaska And
Exxon Shipping Company" was adopted on May 18, 1989; and
WHEREAS, the audit firm of Price Waterhouse felt that
Section 5 regarding purchasing needed clarification; and
WHEREAS, the Mayor and Assembly discussed the payment of
overtime up to the amount reimbursed by Exxon to the Mayor and
Department Heads; and
WHEREAS, the expenditures have been administered within
those guidelines; and
WHEREAS, this provision has been terminated by Ordinance
89 -33 -0 effective November 22, 1989;
NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island
Borough Assembly that Ordinance 89 -15 -0 is amended as follows:
Section 5. The provisions of KIB Code 3.16.020,
Limitation on Mayor's Authority, and 2.12.411, Overtime, are waived
for oil spill related purchases. Overtime pay for Department Heads
and the Mayor as reimbursed by Exxon are approved.
