KODIAK ISLAND BOROUGH
ORDINANCE NO. 86 -32-0
AN ORDINANCE ESTABLISHING THE BAY VIEW ROAD SERVICE AREA
AND PROVIDING FOR AN ELECTION TO CREATE THE SERVICE
DISTRICT BOUNDARIES
WHEREAS, Monashka Circle and Bay View Drive were completed in 1986;
WHEREAS, the grants which provided funding for constructing those
roads require that maintenance be done by the local municipality; and
WHEREAS, Kodiak Island Borough Code Section 4.05.040 provides that the
Assembly initiate action to create a service area by introducing an
ordinance; and
WHEREAS, Section 4.05.060 provides that an ordinance creating a
service area shall not be effective unless approved by a majority of the
qualified voters voting on the question in the area affected by the
ordinance.
NOW, THEREFORE, BE IT ORDIANED by the Kodiak Island Borough Assembly
that:
Section 1: The area known as Bay View Road Service Area is hereby
created for the following described area:
All of that portion of land lying within Section 20 and
21, Township 27 South, Range 19 West, Seward Meridian,
Alaska, platted as Lots 2 through 22, Block 1, and Lots 1
through 10, Block 2, and the included Monashka Circle and
Bay View Drive rights -of -way, Monashka Bay Alaska
Subdivision, recorded in the Kodiak Recording District on
September 9, 1968, Plat No. 68 -8.
Section 2: An election shall be held on Tuesday, October 7, 1986,
between the hours of 7:00 am and 8:00 pm of said date and there shall be
submitted to the duly qualified residents and voters of Bay View Road
Service Area and Blocks 1 and 2, Monashka Bya Alaska Subidivision the
following question:
"Shall the Bay View Road Service Area be established for
the following described area:
All of that portion of land lying within Section 20 and
21, Township 27 South, Range 19 West, Seward Meridian,
Alaska, platted as Lots 2 through 22, Block 1, and Lots 1
through 10, Block 2, and the included Monashka Circle and
Bay View Drive rights -of -way, Monashka Bay Alaska
Subdivision, recorded in the Kodiak Recording District on
September 9, 1968, Plat No. 68 -8 ?"

Section 3: A person who is qualified to vote in Alaska and the Kodiak
Island Borough and who is a resident of the Bay View Road Service Area or
the area described in this ordinance may vote in the election.
Section 4: The polling place for this election will be the East
Elementary School, Mission Road Precinct.
Section 5: Notice of the election shall be published not less than
thirty days prior to the election in the form and manner provided by AS
29.38.050 and Title 2 of the Kodiak Island Borough Code of Ordinances.
Section 6: Upon passage of the proposition to establish the
boundaries of the Bay View Road Service Area by the qualified voters of
that area, and upon certification of said election, this ordinance shall
become effective.
