ORDINANCE NO. 86 -18 -0
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING CHAPTER
17.36 (NONCONFORMING USES AND STRUCTURES) OF THE BOROUGH CODE.
The Kodiak Island Borough Assembly hereby ordains that:
Section 1: That this ordinance is of a general and permanent nature
nd shall become a part of the Code of Ordinances of the Kodiak Island
orough.
Section 2: Section 17.36.020, INTENT, is hereby amended as follows:
17.36.020 Intent. Within the land use districts established by
his title there exist lots, structures and uses of land and structures which
ere lawful before the ordinances codified in this title were passed or
mended, but which would be prohibited under the existing terms of this title
r future amendments.
It is the intent of this chapter to permit these nonconformities to
( continue until they are removed. Seek Nonconforming uses are declared by this
I chapter to be incompatible with permitted uses in the land use districts
'involved.
It is feether the intent of this chapter that mefeeeferm4t4ee
monconforming uses shall not be enlarged upon, expanded or extended, nor be
used as grounds for adding other structures or uses prohibited elsewhere in
the same district.
It is further the intent of this chapter that nonconforming{
structures may not be enlarged upon, expanded or extended in any way that
increases the nonconformity.
Section 3: Section 17.36.070, GENERAL PROVISIONS, C, REPAIRS AND
MAINTENANCE, is hereby amended as follows:
17.36.070 General Provisions.
C. Repairs and Maintenance.
On any nee teeefersens- eteaetere- er- en-eny building devoted in whole
or in part to any nonconforming use, work may be done in any period of twelve
(12) consecutive months on ordinary repairs, or on repair or replacement of
nonbearing walls, fixtures, wiring or plumbing, provided that the cubical

content of the building as it existed at the time of passage or amendment of
the ordinance codified herein shall not be increased.
Section 4: This ordinance shall be in full force and effect upon
passage and adoption.
