1986-02 Pertaining to Payments Due and Payable to the BoroughKODIAK ISLAND BOROUGH
ORDINANCE NO. 86 -02 -0
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY PERTAINING TO
PAYMENTS DUE AND PAYABLE TO THE BOROUGH.
WHEREAS, the form and identification of payments due to the Borough
has not previously been deliniated in the code, and
WHEREAS, dishonored checks seem to be increasing significantly.
NOW THEREFORE, BE IT ORDAINED, that Section 3.10 of the Kodiak
Island Borough Code be added as follows:

3.10.090 Dishonored Checks
3.10.010 General. The Kodiak Island Borough (Borough) accepts payments
from various sources in satisfaction for obligations due to the Borough.
3.10.020 Form of Payment. Generally the Borough will accept payment in
any form in satisfaction for any obligation due to the Borough. This must be
in currency, check, postal money order, electronic fund transfer or such other
form that is than current as legal tender for liquidation of debts in United
States of America funds.
3.10.021 Exceptions to Form. The Borough reserves the right to refuse
certain forms of payment and to demand United States currency only in certain
cases. This demand will be held to a minimum and will normally only be
exercised in cases of tax foreclosure sales, amounts tendered by known bad
check writers and such situations.
3.10.030 Identification of Payment. All payments tendered to the
Borough should be identified as to the obligation the payee is proposing to
liquidate. This is especially necessary when payment is tendered by mail.
3.10.090 Dishonored Checks. The Borough will charge a fee of fifteen
($15.00) dollars for returned checks. This fee will in no way negate other
remedies available to the Borough under other laws, e.g., felony prosecution
for a large check on a closed account.
All , '_nances or parts of ordinances )und to be in conflict with
this ordinance are hereby explicitly rescinded.
Upon passage, this ordinance shall take effect immediately.
