1981-55 Amending Chapter 17.09 Zoning Map District Boundaries1 ! : 7 -' 1 7 KODIAK ISLAND BOROUGH ORDINANCE NO. 81 -55 -0 AN ORDINANCE AMENDING CHAPTER 17.09 ZONING MAP DISTRICT BOUNDARIES. The Kodiak Island Borough Assembly Ordains that: SECTION 1: Chapter 17.09 Zoning Map District Boundaries is hereby amended to read as follows: CHAPTER 17.09 OFFICIAL ZONING MAP AND DISTRICT BOUNDARIES SECTIONS: 17.09.010 17.09:020 17.09.030 17.09.035 17.09.040 17.09.050 17.09.060 Districts Established Zoning map Zoning map changes Zoning map location Zoning map replacement Interpretation of District Boundaries Temporary classification of land. 17.09.010 Districts established. The Borough is divided into the follow- ing land use districts: A. W - Watershed District; B. WH- Wildlife Habitat; C. C- Conservation District; D. RR -Rural residential district; E. R1- Single family residential district; F. R2 -Two family residential district; G. R3- Multilple family residential district; H. B- Business district; I. I- Industrial District; and J. PL- Public lands district. 17.09.020 Zoning Map. The land use districts are bounded and defined on the "Zoning Map of the Kodiak Island Borough ". A certified copy of the map will be located in the Borough Clerk's Office and the Community Development Department. 17.09.030 Zoning Map Changes. No changes of any nature shall be made on the official zoning map except in conformity with the procedures set forth in this chapter. Any unauthorized change by any person or persons shall be con- sidered a violation of this Title and punishable as provided under Chapter 17.75. 17.09.035 Zoning Map Location. Regardless of the reported existence of copies of the zoning map which may from time to time be made or published, the Official Zoning Map shall be located in and maintained by the Community Develop- ment Department and is the final authority on the current status of zoning in the Borough. 17.09.040 Zoning Map Replacement. In the event the Official Zoning Map is damaged, destroyed or becomes difficult to interpret due to a large number of IKODIAK ISLAND BOROUGH pRDIAN6- N. 8l '�-0-! 7 PAAGE 2 Official Zoning Map which supersedes all prior versions of the map. 17.09.050 Interpretation of District Boundaries. When uncertainty exit' about the boundaries of districts shown on the zoning map, the following rule_ apply: A. Boundaries indicated as following the centerline of streets, highways or alleys will be interpreted to follow such centerlines; B. Boundaries indicated as following platted lot lines will be interpreted as following such lot lines; C. Boundaries indicated as following section or subdivision lines will be interpreted as following such section or subdivision lines. Boundaries indicated as following borough or city limits lines will be interpreted as following the borough or city limits line. D. Boundaries indicated as following shorelines will be interpreted to follow such shorelines and in the event of changes in the shoreline will be interpreted as moving with the actual shoreline; boundaries indicated as follow -. ing the centerlines of streams, rivers, canals, lakes or other bodies of water will be interpreted to follow such centerlines; E. On unsubdivided property, the location of any district boundary, shall be determined by the use of the scale or dimensions appearing on the map; F. Boundaries indicated as parallel to or extensions of features indicated in subsections A through E above shall be so interpreted. Distances not specifically indicated on the Official Zoning Map shall be determined by the scale of the map; G. Where physical or cultural features existing on the ground do not agree with those shown on the zoning map, or in other circumstances not covered by subsections A through F above, the Board of Adjustment shall inter pret the district boundaries; H. Where any public street. or alley is vacated, the regulations applicable to each parcel of abutting property shall apply to the portion of the street or alley added by virture of the vacation. 17.09.060 Temporary Classification of Land. Any land included within the corporate boundaries of the Borough, subsequent to the adoption of this Title shall automatically classified in the C- Conservation District.
