1976-14 Rezoning To Be Designated a Playground to Be0) 1 t1 IKD16K ($LAND BOROUGH ORDINANCE NUMBER 76- 14-0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOTS 35 THROUGH 53, 58, 59 AND 7, BLOCK 12, ALEUTIAN HOMES SUBDIVISION; LOTS 3, 4, 5, 6, BLOCK 11, ALEUTIAN HOMES SUBDIVISION; LOTS 17 AND 18, BLOCK 8, ALEUTIAN HOMES SUBDIVISION; LOTS 1 THROUGH 10, AND 15 THROUGH 26, 29, 32, AND 33, BLOCK 13, ALEUTIAN HOMES SUBIDIVISION AND THAT LOT 19, BLOCK 12, ALEUTIAN HOMES SUBDIVISION BE DESIGNATED AS A PLAYGROUND TO BE GIVEN TO THE CITY OF KODIAK. WHEREAS, ALASKA STATUTES 29.33.090 empowers the Borough to enact a Zoning Ordinance and provide for its administration, enforcement and amendments, and WHEREAS, the Kodiak Island Borough has pursuant thereto adopted Chapter 5, of its Code of Ordinances and Resolutions which provides for planning and zoning provisions, and WHEREAS, according to the Comprehensive Planning and Zoning Map adopted by the Kodiak Island Borough, Lots 35 through 53, 58, 59, and 7, Block 12; Lots 3, 4, 5, 6, Block 11; Lots 17 and 18, Block 8; Lots 1 through 10, and 15 through 26, 29, 32 and 33, Block 13, and Lot 19, Block 12; Aleutian Homes Subdivision; have been zoned R -1, and, WHEREAS, a petition has been received from property owners of the above referenced lots requesting the same be rezoned from R -1 to Business for future development, and that Lot 19, Block 12, be designated as a playground, and WHEREAS, the Petition was considered and approved by the Planning and Zoning Commission on the 17th day of September, 1975,. after public hearing was held thereon and said body has recommended th reclassification of said property to chang it boundaries to include, Lots 35 thro h 53, 58, 19„ and 7, Block 12; Lots 3, 4, 5, 6, Block 11; Lots 17 and \ ,18, Block 8; Lots 1 through 10, and 15 through 26, 29, 32 and 33, Block 13, Aleutian Homes Subdivision in the Business District and that Lot 19, Block 12, be designated as a playground; and that no objections were voiced at the public hearing; it having been determined that the public necessity, convenience, and good zoning practice require reclassification, 1 NOW, THEREFORE, BE IT ORDAINED, by the Borough Assembly of the Kodiak Island Borough that the property described as: Lots 35 through 53, 58, 59, and 7, Block 12; Lots 3, 4, 5, 6, Block 11; Lots 17 and 18, Block 8; Lots 1 through 10, 15, 16, 26, 29, 32 and 33, Block 13; Aleutian Homes Subdivision; and Lot 19, Block 12, Aleutian Homes Subdivision be designated as a playground Be and the same are hereby reclassified as Business and that notice of this ordinance be given by publication in the KODIAK MIRROR seven (7) days prior to the second reading and that public hearing be held thereon on the date of the second reading and that this ordinance become effective at the time of adoption.
