AN OR NANCE REGULATING THE SEVERANCE OF CONIFERS
The Kod -k Island Borough Assembly hereby ordains:
Section I . That Section 10 of Subchapter 2, Chapter 5 of the Kodiak
Island Bor• gh Code of Ordinances is amended by adding a new sub-
section J to -ad as follows:
J . TIMBER REMOVAL: (a) No person may cut, all or
remove timber f om property located in Unclassified or R idential Zones
except as permitt=• in this section, without first obt ing a permit from
the Planning and Z• ing Commission for an addit •nal use as described in
Section 11 (a) (10) of is subchapter. (b) •roperty owner may cut,
clear or remove timber rom an area to b occupied by a building and a
distance of 50 feet aroun• the building site or such other greater distance
as is necessary to protect e bui • ing from possible damage by falling
trees. In addition he may re's •ve not more than 65% of the trees six inches
or more in diameter from = • ch 00 square foot area of the property, how-
ever any number of s - Iler tree may be removed at any time (c)
An application for - additional us to cut, clear or remove trees shall be
by a developme t plan and schedule or the property to be cleared, and a
statement u .er oath concerning the i ended use. If the Commission deter-
mines t - the commercial value of the tr es to be cut is high in relation to
the v- ue of the property for residential p poses after the cutting, the
Co mission may require, as a condition of t permit that the applicant
post a porporate surety bond in a principal a .unt equal to the estimated
value of the severed timber prior to the transpo tation or processing.
The bond shall be payable to the borough if the • -rmit holder fails or
refuses to complete the development in compliance with the approved plan.
Section 2. A public hearing shall be held on this ordinance following
