ORDINANCE NO. 76 -10 -0
AN ORDINANCE REGULATING DISPOSITION OF TREE STUMPS AND
ASSOCIATED ORGANIC MATERIALS
The KODIAK ISLAND BOROUGH ASSEMBLY hereby ordains:
Section I. That Section 10 of Subchapter 2, Chapter 5 of the Kodiak
Island Borough Code of Ordinances is amended by adding a new sub-
section "K" to read as follows:
K. TREE STUMPS AND TRIMMINGS. No person may deposit
or dispose of trees, stumps, roots, trimmings or other similar
organic material on a lot in an area zoned unclassified or
residential unless a special use permit is obtained from the
Planning and Zoning Commission. The application to the
Commission shall be accompanied by a plan to rehabilitate
the lot by leveling and covering the material deposited and
an agreement to comply with the plan, executed by the owner
of the property on which the material is to be deposited.
If the materials are being disposed of in conjunction with a
commercial clearing or construction contract, the Planning
and Zoning Commission may require the execution of a corpor-
ate surety bond in an amount equal to the estimated cost of
leveling and covering the material in compliance with the
plans. The bond shall be payable to the Kodiak Island
Borough if the applicant fails to comply with th rehabilitation
plan.
The special use permit shall be conditioned upon the
agreement,by the property owner that the borough may contract
for or perform the rehabilitation work specified in the plans
and that the permittee will reimburse the borough for the
rehabilitation costs incurred less the recovery on any bond
that may be required.

Section 2. A public hearing shall be held on this ordinance following
notice of such hearing published in the newspaper of general circulation
published at least seven days prior. This ordinance shall become effective
on the date of passage.
