1976-06 Relating to the Acquisition, Transfer, and Disposal of Personal Property and Servicesin 1 5 1 KODIAK ISLAND BOROUGH ORDINANCE NO. 76 -6 -0 AN ORDINANCE RELATING TO THE ACQUISITION, TRANSFER AND DISPOSAL OF PERSONAL PROPERTY AND SERVICES. The Kodiak Island Borough Assembly hereby adains: *SECTION I. That Chapter 3.16 of the Kodiak Island Borough Code of Ordinances is hereby repealed and reenacted to read as follows: Chapter 3.16 CONTRACT, PURCHASE AND SALE PROCEDURE Sections: 3.16.010 Contract, purchase and sale and transfer procedure 3.16.020 Limitation on Mayor's authority. 3.16.030 Open Market Procedures. 3.16.040 Advertising for bids. 3.16.050 Processing of bids. 3.16.060 Local preference. 3.16.070 Exceptions to bidding requirements. 3.16.080 Lowest responsible bidder. 3.16.090 Requirements mandatory. 3.16.010 Contract, purchase and sale and transfer procedure. A. Contract for, purchase or issue purchase authorizations for all supplie s, materials, equipment and services for the offices, departments, and agencies of the borough. B. Sell surplus, obsolete or unusable personal property for the offices, department and agencies of the borough. C. Transfer supplies, material and equipment to or between the offices, departments and agencies of the borough. D. Contract for the construction, repair or improvements of borough facilities. 1 0 0 1 3.16.020 II it I I 7 f Limitation on Mayor's authority. 1.1e mayor may not make an acquisition, sale, transfer or contract authorized by section 010 of this chapter i f the value of the property, service or contract exceeds One Thousand Dollars, ($1,000.00) without first obtaining assembly approval. 3.16.030 Open Market Procedures. A. Purchases, sales or contracts authorized by section 010 of this chapter having an estimated value in excess of One Thousand Dollars ($1,000.00) but less than Three Thousand Dollars, ($3,000.00) shall be made in the open market without newspaper advertisement. B. Market purchases, sales and contracts shall, whenever possible, be based on at least two competitive bids and shall be awarded to the lowest responsible bidder or, in the case of a sale, to the highest responsible bidder. C. The mayor or his authorized designee may solicit either oral or written bids for open market purchases or sales, and shall maintain a record of all bids received. D. The sale of all surplus, obsolete or unusable personal property shall be advertised in the local paper unless authorized to the contrary by the Borough Assembly. 3.16.040 Advertising for bids. A. Purchases, sales or contracts authorized by section 010 of this chapter having an estimated value of more than Three Thousand Dollars ($3,000.00) may be made only after a notice calling for bids is printed in a newspaper of general circulation published within the borough once a week for not less than three consecutive weeks prior to the date for the bid award. The notice shall contain a general description of the property, work or service; state where the bid forms and specifications may be obtained; specify the place for submission of bids and the time by which they must be received. B. The purchase or contract shall be awarded to the lowest responsible bidder, or in the case of a sale, to the highest responsible bidder. II 3.16.0 50 Processin of bids. Notwithstanu,ng other provisions of Ij this chapter relating to the award after competitive bid for purchases, sales 11 1I and contracts, the borough may: 11 A. Reject defective or nonresponsive bids. I C I B. Waive any irregularities in any and all bids. C. Reject all bids. II D. Negotiate with two or more of the lowest bidders, if bid prices II xcess of the money available or authorized, for a reduction in the it are in e \ 1 1 scope, quality or quantity of the purchase, service or contract. E. Readvertise for bids, with or without making changes in the plans or specifications. 3.16.060 Local preference The assembly may, in its discretion, direct an award of a contract for the purchase of personal property or services after competitive bidding to a responsible bidder who maintains a business office or store within the borough from which the property or service would be provided, if that bid does not exceed the lowest responsible bid by more than ten percent. 3.16.070 Exceptions to bidding requirements. The requirements of this chapter relating to solicitation of competitive bids and award to the lowest responsible bidder shall not apply to: A. Contracts for professional or unique services. B. Contracts for property or services necessitated by an emergency, if the delays required for compliance with the bidding require ments would jeopardize the public health or welfare. 3.16.080 Lowest responsible bidder. In determining the lowest responsible bidder, the assembly shall consider: 1 1 1 A. The Did price. B. The ability, capacity and skill of the bidder to perform the contract within the time specified. C. The character, integrity, reputation, judgment and experience II of the bidder. I I D. The quality of performance of previous contracts. 3.16.090 Requirements mandatory. A purchase, contract or sale subject to the provisions of this chapter shall not be valid, enforceable or binding upon the borough unless the established requirements have been satisfied and the contract, purchase or sale approved by the Borough Assembly.
