adopted Title 17, of its Code of Ordinances and Resolutions which provides
KODIAK ISLAND BOROUGH
ORDINANCE NUMBER 76 -2 -0
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
EXTENDING THE BOUNDARIES OF "UNCLASSIFIED" ZONING TO
ENCOMPASS "TRACT J, U. S. SURVEY 1678 AND THE REMAINING PORTION
OF U. S. SURVEY 1678, RECLASSIFICATION FROM CONSERVATION TO
UNCLASSIFIED.
WHEREAS, Alaska Statutes 29.33.090 empowers the Borough
to enact a Zoning Ordinance and provide for its administration,
enforcement and amendments, and
for planning and zoning provisions and procedures, and
WHEREAS, according to the Comprehensive Planning and
Zoning Map adopted by the Kodiak Island Borough, that portion
encompassed by the boundaries of the Proposed Mountain View Subdivision,
U. S. Survey 1678, has been zoned Conservation, and
WHEREAS, a petition has been received from Lee Russell
requesting the same to be rezoned from Conservation to Unclassifed for
future sale and evelopment, and
WHEREAS, the Petition was considered and approved by the
Planning and Zoning Commission on December 17, 1975, and a
determination was made that a public hearing was not necessary as this
would only extend a present zoning district, said body has recommended
the extension of the boundaries of "Unclassified Zoning" to encompass
Tract J and the remaining portions of U. S. Survey 1678,
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly
of the Kodiak Island Borough that the property described as:
Tract J (Mountain View Subdivision) of U. S. Survey 1678
and the remaining portion of U. S. Survey 1678

ATTEST:
Be and the same are hereby reclassified as Unclassified and that notice
of this ordinance be given by publication in the KODIAK MIRROR, seven
(7) days prior to the second reading and that a public hearing be held
thereon on the date of the second reading and that this ordinance become
effective at the time of adoption.
