From the Requirements of Section 39.50.145 of the Alaska Statutes Relating to Disclosure Statements and Conflicts of Interest1 5 � KODIAK ISLAND BOROUGH ORDINANCE NO. 7S -20 -0 AN ORDINANCE EXEMPTING MUNICIPAL OFFICERS OF THE KODIAK ISLAND BOROUGH FROM THE REQUIREMENTS OF SECTION 39.50.145 OF THE ALASKA STATUTES RELATING TO DISCLOSURE STATEMENTS AND CONFLICTS OF INTEREST. WHEREAS, the legislature of the State of Alaska has adopted chapter 25 of the Session Laws of 1975, containing extensive provisions relating to the disclosure and reporting of financial and business interests of public officials, and prohibiting various types of conflicts of interest; and, WHEREAS, the provisions of that act are applicable to municipal officers of the Kodiak Island Borough unless a majority of the voters voting on the question at a general election approve an ordinance exempting its municipal officers from the requirements of the state provisions; and, WHEREAS, the disclosure requirements of the state conflicts of interest act impose extensive record keeping with regard to minor transactions and are otherwise unduly burdensome; and, WHEREAS, the disclosure requirements of state law have precipitated numerous resignations by elected and appointed state officials subject to its provisions and would serve to discourage qualified persons from seeking municipal office within the Kodiak Island Borough; and, WHEREAS, adequate provisions relating to disclosure of business and financial interests and conflicts of interest by municipal officers may be enacted by local ordinance, NOW, THEREFORE, be it ordained by the counsel of the Kodiak Island Borough, Kodiak, Alaska, as follows: SECTION 1. The municipal officers of the Kodiak Island Page One, Ordinance No. 75 -20 -0 1 1 kZc ,,Gt� shall be exempted from all requirements of Chapter 39.50 of the Alaska Statutes relating to disclosure of financial and business interests and conflicts of interest, if the exemption is approved by the voters of the Kodiak Island Borough. SECTION 2. An election is to be held on Tuesday, October 7, 1975, in and for the Kodiak Island Borough, Kodiak, Alaska, and the following proposition shall be submitted to the qualified voters of the Kodiak Island Borough for approval or rejection. A majority of those electors qualified and voting in favor of the proposition shall be required for approval. PROPOSITION NO. Shall municipal officers and candidates for municipal office in the Kodiak Island Borough be exempted from the requirements of Chapter 39.50 of the Alaska Statutes which established reporting and disclosure requirements for financial and business interests of municipal officers and otherwise prohibits activities determined to be in conflict with the municipal interests represented by the officer. SECTION 3. The foregoing proposition shall be printed in full on a ballot and the following words shall be added below or next to the proposition as appropriate and next to a square provided for marking the ballot. A person may vote at the general election who possesses the qualifications set forth in AS 15.05.010 and Section 2.04.190 of the Kodiak Island Borough Code of Ordinances.
