ORDINANCE NUMBER 75 -17 -0
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
RECLASSIFYING THAT PORTION OF U. S. SURVEY 1682 THAT WOULD
BE ENCOMPASSED BY THE BOUNDARIES OF THE WOODLAND ACRES
SUBDIVISION, SECOND ADDITION, FROM CONSERVATION TO UNCLASSIFIED.
WHEREAS, ALASKA STATUTES 29.33.090 empowers the Borough
to enact a Zoning Ordinance and provide for its administration,
enforcement and amendments, and
WHEREAS, the Kodiak Island Borough has pursuant thereto adopted
Chapter 5, of its Code of Ordinances and Resolutions which provides for
planning and zoning provisions and procedures, and
WHEREAS, according to the Comprehensive Planning and Zoning Map
adopted by the Kodiak Island Borough, that portion encompassed by the
boundaries of the proposed Woodland Acres Subdivision, Second Addition,
U. S. Survey 1682, has been zoned Conservation, and
WHEREAS, a petition has been received from Island Resources
requesting the same to be rezoned from Conservation to Unclassified for
future sale, and
WHEREAS, the Petition was considered and approved by the Planning
and Zoning Commission on April 23, 1975, after a public hearing was held
thereon and said body has recommended the reclassification of said
property to change its boundaries to include that portion of U. S. Survey 1682,
encompassed by the boundaries of the Woodland Acres Subdivision, Second
Addition, and some objections were voiced of putting trailers on the land,
from property owners nearby, it was then clarified that the land was sold
with the stipulation that no trailers could be put on the property, it having
been determined that the public necessity, convenience, and good zoning
practice require reclassification
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly of
the Kodiak Island Borough that the property described as:

That portion of U. S. Survey 1682, encompassed by the
boundaries of the Woodland Acres Subdivision, Second
Addition,
Be and the same are hereby reclassified as Unclassified and that notice
of this ordinance be given by publication in the KODIAK MIRROR, seven
(7) days prior to the second reading and that public hearing be held
thereon on the date of the second reading and that this ordinance become
effective at the time of adoption.
