EMERGENCY ORDINANCE NUMBER 74 -40 -EO
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
( DECLARING AN EMERGENCY AND WAIVING CERTAIN BID REQUIREMENTS
WHEREAS, the Kodiak Island Borough entered into a Contract
with Northland Construction Company on July 5, 1972, for the
Construction of the Ouzinkie School Project, and
Whereas, it was necessary to go into Litigation over
'the construction of the Water and Sewer lines, and under the
agreement of the litigation this construction was to be finished
by September 1, 1974, before the start of a new school year, and
WHEREAS, it now appears that this completion will not be
done, and due to the time factor involved and the seasonal
building time and for reasons of the health and welfare of the
school children,
BE IT ORDAINED that an emergency does exist and that in
order to have this project completed before freeze up, it is
necessary to seek bids and have this work done as soon as possible
the Borough Assembly does hereby waive the publication of bid
requirements. This waiver does not mean that competitive bids will
I not be sought, only the requirement for advertising for such bids.
