ORDINANCE NUMBER 74 -39 -0
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
REZONING A PORTION OF U. S. SURVEY 1396, BLOCK 1 AND 3 ZONED
TO R -3 AND BLOCK 2, ZONED TO R- 2.(RUSSELL ESTATES)
WHEREAS, ALASKA SWAM 29.33.090 empowers the Borough to
enact a ZonixigrOrlinance and provide for its administration, enfaxment
and am ailments, and
REFERS, the Kodiak Island Borough has pursuant thereto adopted
Chapter 5 of its Code of Ordinance and Aesoluticns, which provides for
ply and zoning provisions and procedures, and
WAS, acoarding to the Oonprehensive Flaming and Zoning Map
opted by the Kodiak Island Borough, U. S. Survey 1396 has been zoned
unclassified, R-2 and R-3, and
AS, a petition has been received from Lee Russell requesting
that a portion of that survey be rezoned fran the present zming to allow
for proposed subdivision to be vaned R-2 and R-3,
WS, the Petition was considered and app by the Planning
Ctumissicn on the 21st day of August, 1974, after a public hearing was held
thereon and said body has r'e:amended the reclassification of said property
to R-2 and R-3 and n ::objections were voiced at the public hearing, it having
been determined that the public necessity, convenience and good zoning
Practice require such reclassification,
N74, THEREFORE, BE IT ORDAINED by the Borough Assembly of the
Kodiak Island Borough that the property described as:
Russell Estates, Block 1, Block 2, and Block 3 of
U. S. Survey 1396
Be and the same is hereby reclassified as follows: Block 1 and Block 3
Zcned R-3 and Block 2, zoned R-2 and that notice of this Ordinance be given

publication in the KODIAIK MIRROR seven (7) days prior to the seoaed
reading and that a public hearing be held thereon on the date of the
second reading and that this Ordinance beoane effective at the time
of adapticai.
