AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH ASSEMBLY REZONING A PORTION OF U. S. SURVEY 2539
FROM CONSERVATION TO BUSINESS.
WHEREAS, ALASKA STATUTES 29.33.090 empowers the
Borough to enact a Zoning Ordinance and provide for its administration
enforcement and amendment, and
WHEREAS, the Kodiak Island Borough has pursuant thereto
adopted Chapter 5, of its Code of Ordinances and Resolutions, which
provides for planning and zoning provisions and procedures, and
WHEREAS, according to the Comprehensive Planning and Zoning
Map adopted by the Kodiak Island Borough, this portion of U. S.
Survey 2539 has been zoned Conservation and,
WHEREAS, this portion of land has been leased to MR. EUGENE
BRASIE, for a period of fifty -five years and the Planning and Zoning
Commission felt that it should be zoned commercial in order to conform
with his development plan,
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly
of the Kodiak Island Borough that the property described as:
A 15.85 tract of U. S. Survey 2539, A.D.L. No. 72 -11
Be and the same hereby reclassified as Business and that notice of this
ordinance be given publication in the KODIAK MIRROR, seven (7) days
prior to the second reading and that a public hearing be held thereon the
date of the second reading and that this Ordinance become effective at the
time of adoption.
