1974-19 Relating to Uses of Property Associated With Natural Resources2 41 % z KODIAK ISLAND BOROUGH ORDINANCE NUMBER 74 -19 -0 AN ORDINANCE RELATING TO USES OF PROPERTY ASSOCIATED WITH REMOVAL, EXCAVATION AND SALE OF NATURAL RESOURCES. *Section 1. Section 9 B of subchapter 2, Chapter 5, is hereby amended to read: Use. A business or activity conducted on any portion 3rthe property, the purpose for which the property is presently utilized and the purpose for which any portion of the property is designed, intended, occupied or maintained. *Section 2. Sub - section 10, Section 11, subchapter 2, Chapter 5 is hereby amended to read: 10. Exploration, development and extraction of natural resources for commercial purposes, together with the erection of construction of buildings, apparatus or appurtenances necessary to the use. As used in this paragraph, exploration, development and extraction of natural resources for commercial purposes includes but is not limited to: (a) petroleum exploration and development (b) a project for removal and sale of all or substantially all of the merchantable timber from one or more platted lot in unclassified or residential zones. (c) a project for the extraction and removal of rock, gravel or other minerals exceeding 1500 cubic yards in quantity based on in place measure, from one or more platted lots in an unclassified or residential zone, whether or not payment is received for the materials removed from the lot. *Section 3. Section 17, of subchapter 2, Chapter 5, is hereby amended to read: Section 17. Approval by the Planning Commission. A. When the approval of the Planning Commission is required by this Code for an additional use or other permitted uses of property or structures, the property owner shall submit a written application for approval accompanied by required plans and data. B. The application shall be submitted to the Planning Commission through the Clerk and shall state the section or sub- section of these ordinances under which the approval is authorized, provide an adequate description of the property, contain a narrative statement explaining the factors that make the proposed use appropriate to the area and in compliance with the standards of the section authorizing the approval, the features in detail of the use, a schedule and timing of the construction, utilization or activity, and any other material which the applicant believes to be relevant to the application. A schematic site plan showing the type and location of all uses on the property and all major vehicular and pedestrian patterns relevant to the proposes use shall be submitted with the application. Section 4: A public hearing shall be held on this ordinance following notice of such hearing published in the newspaper of general circulation published at least seven days prior This ordinance shall become effective on date of passage. ATTEST: Borough Clerk/Treasurer C. The application shall be placed on the agenda for the next regular meeting of the Planning Commission for presentation in accordance with the Code unless the applicant requests that the procedures be expedited and provides reasons for requesting the early decision. If expedited procedures are requested, the Clerk shall review the application and accompanhing data and if it is sufficiently complete, prepare a notice of public hearing,, request the planning commission to meet and hold a public hearing on the request in less than days after filing of the application. The Planning Commission shall make a decision on the matter following the public hearing and a presentation by the applicant unless insufficient information or data has been provided upon which to formulate a decision. D. The Planning Commission shall make its findings and determination on all other applications within 40 days from the day of filing of the application and shall notify the applicant in writing of their decision. If approval is denied, the Commission shall state their reasons and the donditions, if any, under which the application will be approved.
