ORDINANCE NUMBER 74 -8 - 0
AN ORDINANCE RELATING TO PENALTIES PRESCRIBED FOR
VIOLATION OF ORDINANCES
The Kodiak Island Borough Assembly hereby ordains:
*Section 1. That Section 11 of Chapter 1 of the Kodiak Island
Borough Code of Ordinances is amended to read:
Section 11. Penalties. A violation of a provision of
this Code of Ordinances is an offense punishable upon conviction
by a fine of not more that $500 or by imprisonment not to exceed
thirty (30) days, or both. If another penalty is established
by ordinance for the provision violated that penalty shall apply.
Each day during which a continuing violation exist or is repeated
shall be a separate and distinct violation.
Section 2. That Section 4, Subchapter 1, Chapter 5 of the
Kodiak Island Borough Code of Ordinances is here repealed.
it 1 1 *Section 3. That Section 3 of Subchapter 2, Chapter 3 is amended
to read:
Section 3. Penalties. A person who fails, refuses or
neglects to file a personal property return in accordance with
Sections 1 and 2 of the Subchapter shall, in addition to other
penalties provided by law, be liable for a penalty of ten per
cent (10%) of the tax assessed against said personal property
as assessed by the Borough Assessor, in accordance with
Section 1 of this subchapter. Said person shall pay interest
at the rate of eight per cent (8%) per annuq exclusive of
penalty, from the due date until paid in full. This section
shall apply to all persons having personal property within the
Kodiak Island Borough, irrespective of residence. However,
when such penalty and interest amounts to ONE DOLLAR ($1.00) or
less there shall be assessed a minimum penalty of ONE DOLLAR
($1.00) .

Section 4. That Subsection C of Section 10, Subchapter 4
of Chapter 5 of the Kodiak Island Borough Code of Ordinances
is hereby repealed.
Section 5. That the paragraph entitled "Enforcements and
Penalties" contained in Section 4 of Subchapter 3, Chapter 5,
of the Kodiak Island Borough Code of Ordinances is hereby
repealed.
Section 6. That subsection C of Section 20, Subchapter 2 of
Chapter 5 of the Kodiak Island Borough Code of Ordinances is
hereby repealed.
Section 7. That Section 50 of Chapter 6 of the Kodiak Island
Borough Code of Ordinances is hereby repealed.
