1972-23 Rezoning U.S. Survey 3099 to R-1I KODIAK ISLAND BOROUGH ORDINANCE NUMBER 72 -23 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOT TWENTY -FIVE (25) OF U. S. SURVEY NO. 3099 FROM UNCLASSIFIED TO R -1 WHEREAS, AS 07.15.340 empowers the Borough to enact zoning ordinances and provide for their administration, enforcement and amendment, and WHEREAS, the Kodiak Island Borough has pursuant thereto adopted Chapter 5 of its Code of Ordinances and Resolutions, which provides for planning and zoning provisions and procedures, and WHEREAS, according to the Comprehensive Planning and Zoning Map adopted by the Kodiak Island Borough, Lot Twenty -five (25) of U. S. Survey No. 3099 is zoned and has been classified as Unclassified, and WHEREAS, MARGARET EMMONS has filed with the Kodiak Island Borough Planning and Zoning Commission a vacation of Lot Twenty -five (25), U. S. Survey NO. 3099 and replat of the same into Lots Twenty -five (25) A, B and D, subdividing said Lot into lots ranging in size from 5,000 to 10,000 square feet, and has stated in her Petition that the replat area has City water on Mission Road of an eight -inch diameter and a sanitary sewer will be connected with a six -inch line to an approved manhole with an eight -inch line, and has requested that said property be reclassified to R -1, and WHEREAS, the request for rezoning was denied by the Borough Planning and Zoning Commission, as they felt it would be spot zoning, and the Petitioner having appealed to the Kodiak Island Borough Assembly as the Board of Appeals and the Assembly having considered the Appeal at its regular Page One, ORDINANCE NO. 72 -23 -0 me o: t. t II t L eetinq held on the 7th day of September, 1972, and in view the fact that there are several lots within this survey iat do not presently meet the requirements for lot size, and aat the Petitioner has indicated that she will be hooking up o City water and to a private sewer system, and therefore ould not then require the same lot size, and 1 WHEREAS, the size of said lots being based partly )n the necessity of that area to have septic tanks or wells, ind the Borough noting that it is the intention of the people in this area to come into the City Limits, and that the larger size lots would not be required, nor could a person afford to have sewer and water and still maintain a large lot, and therefore it being determined that the public necessity, convenience and good zoning practices require such classification. NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly of the Kodiak island Borough that the property known and described as Lot Twenty-five (25), U. S. Survey No. 3099, now reclassifi ' classified as Unclassified, be and the same is hereby as R -1, and that Notice of this Ordinance be given by p ublication in the Kodiak Mirror seven (7) days Prior to the second reading, and that a public hearing be held thereon on the date of the second reading, and that this Ordinance become effective at the expiration of thirty (30) days after its adoption and the Comprehensive Planning and Zoning Map changed accordingly.
